Council Minutes of 2/6/01 <br />,~ Olmsted. Under the supremacy clause of the U. S. Constitution, the city cannot impose <br />any types of state or local building regulations against a federal agency unless the federal <br />agency chooses to abide by those local regulations. <br />Finance Director Copfer: 1) The November revenue and expenditure reports were <br />delivered to Council's mailboxes on January Z. The December revenue and expenditure/ <br />encumbrance and appropriations ledgers were delivered to Council's mailboxes this <br />evening. Also given to Council was a copy of the investments made in 2000. <br />2) On January 17, the $8 million bond anticipation notes were sold. We received a rate <br />of 3.75% interest. These were closed on January 31, and the money is safely invested. <br />Mrs. Kasler, chairperson of the Intra-Governmental Relations and Legislation; Long- <br />Range Planning Committee: 1) The committee met on Tuesday, January 30. Present <br />were committee members Kasler, Miller and Nashar and all other voting members of <br />Council, Mayor Musial and Assistant Law Director Dubelko. The committee discussed <br />Ordinance 2001-05, which is an ordinance creating new Chapter 177 of the city <br />Administrative Code entitled "Community Access" in order to establish anon-public <br />fora, permitting community organizations to announce community events in certain <br />media owned and operated by the city and further to permit such organizations to <br />announce such events on banners erected in a limited air space area above Lorain Road, <br />near the North Olmsted Community Park. Several issues of concern were raised <br />regarding the ordinance: <br />• The cost to the city for erecting and dismantling banners at the park location and the <br />possibility of a fee associated with that service. <br />• The frequency of the ability of the organizations to place a banner, which now reads <br />in the ordinance as four a year per organization. <br />• Whether there should be a restriction of the months that banners are permitted <br />because of weather conditions during the winter. There may be liability concerns <br />about a banner across the road being disturbed by inclement weather. <br />• The possibility of fiuther defining "community organization" to require atwo-year <br />residency of the organization in the city. <br />• A change in the application review process, from the Mayor's present proposal that <br />the Mayor's Administrative Assistant or designee review the application and author <br />opinions on any application that was denied, to instead mandating that a review of <br />that process be done by the Law Department. <br />• The committee further requested the review of 177.06 to determine if any additional <br />standards might be warranted with regard to the construction of any kind of banner <br />across the road. <br />• Liability issues were also discussed and several concerns remained at the end of the <br />committee meeting to the extent that the Legislative Committee voted unanimously <br />to hold Ordinance 2001-05 in committee until further review by the Law Department <br />and administration. <br />2) The committee interviewed Elaine Diederich, who was appointed by the Mayor to the <br />Housing Council for the open term of 1/1/99 to 12/31/01. Ms. Diederich is a practicing <br />CPA and has a thorough understanding of tax abatement and tax issues. She is presently <br />a volunteer in various activities throughout the city and other cities as well. She is the <br />3 <br /> <br />
