Council Minutes of 12/3/2002 <br />Jesse has since written a memo to Council stating that he and the Mayor had discussed <br />the topic of having media inquiries referred to the Mayor's office. That discussion took <br />place prior to the memo being written. Also, Mr. Jesse has admitted to correcting a <br />misspelling in the memo. Council cannot tolerate, and she as an individual <br />Councilperson will not tolerate misrepresentations or lies being made to Council by the <br />administration. Not only is Council being deceived, but the citizens are being deceived <br />and their rights and privileges to the truth are being abused and ignored. Mrs. Kasler <br />asked that the Mayor request Mr. Jesse's resignation. Mayor Musial said he had not seen <br />the memo and that is why he called it "bogus." He was concerned that the memo had no <br />signature or indication of authorship and has now directed that all memos aze to be <br />identified by a signature or initials. Mr. Miller said he agreed that there had been an <br />attempt to deceive Council and agreed with Mrs. Kasler's request for the Safety <br />Director's resignation. Mayor Musial said he was not considering any disciplinary <br />actions against the Safety Director at this time. <br />Councilman Miller asked the Mayor how many applicants had applied for the positions <br />of Service Director and Safety Director. Mayor Musial replied there were 13 or 14 <br />applicants for the Service Director position and no applicants for the position of Safety <br />Director. <br />Law Director Dubelko: 1) On November 20, he attended the VFW award dinner for the <br />North Olmsted Fire Fighter and Police Officer of the Yeaz. Congratulations to Police <br />Officer Tim Cook and Fire Fighter Dave Mortash for their awazds. <br />2) November 22, he provided a legal memorandum to Council member Miller regazding <br />administrative and legislative functions regarding comp time policy. <br />3) On November 25, the Law Department's sub-web page was up and running. Thank <br />you to Joan Gency and Mike Jaworske for their efforts in connecting the Law Department <br />to the city's web site. All of the legal opinions issued by the Law Director this yeaz aze <br />now on the site and available to members of the administration and Council as well as to <br />the public, along with a-mail and phone numbers for the Law Department personnel. <br />4) On November 26, he issued Legal Opinion No. 2002-19 regarding the Mayor's <br />authority to unilaterally reduce the salaries of appointed directors within the salary range <br />established by Council. <br />5) On November 26, he attended Community Council's dinner for the installation of <br />their officers. Congratulations to city employee Tom Herbster who completed two years <br />as the Community Council president. Tom exemplifies volunteerism in the City of North <br />Olmsted. <br />6) He is currently serving on jury duty. <br />Finance Director Copfer: 1) Along with Personnel Director Farver, she met with the <br />Bureau of Workers' Compensation representative regarding changing the way the city <br />pays workers' compensation premiums, from a premium based on payroll dollazs to a <br />retrospective premium base. Retrospective premium base is about the closest thing <br />municipalities can get to aself-insured program as legally possible under the State of <br />Ohio. The city has a good history with managing its workers' comp claims and offering <br />transitional work jobs. If our history is any predictor on future claims experience, and <br />3 <br />
