Council Minutes 11/6/2002 <br />further asked whether Mr. Marshall has city employees who would be working for him <br />and also working for his separate business. Mr. Miller questioned whether or not, if <br />contractors have employees also working for the city, whether they should also disclose <br />that. Ms. Drenski explained that under the contract, he doesn't use his own employees <br />but rather managers Recreation employees. There is no conflict as far as she can tell. <br />The Safety Director acknowledged that, in some instances, this conflict relationship in his <br />working in various municipalities and disclosure of some sort of conflict or relationship <br />interests are good issues to discuss, but perhaps we should move forward with this <br />contract and address that in a larger sense with other contracts given particularly the fact <br />that Mr. Marshall has been working without a contract. Mr. Limpert suggested this be <br />considered among future issues, and Mr. Gareau agreed and said there are many issues to <br />address and this is just one of them. Mr. Miller asked again whether the summer ice <br />program was feasible to continue, whether his program in general was feasible given the <br />overall cost of the program and the high maintenance of summer ice. Again this matter <br />was addressed and Ms. Drenski said it was feasible. Mr. Jesse agreed with Mr. Miller <br />about the feasibility but again noted this is something we need to consider in the overall <br />restructuring of the Rec Department as opposed to simply imposing it upon this particular <br />contract. Mr. Gareau brought up and suggested that this conrtract should require, and it <br />be made a policy of the city, that individual contractors working with children should <br />undergo criminal background checks. Mr. Marshall agreed with that. The Law <br />Department drafted language concerning employees of Mr. Marshall's and, in the future, <br />any contractor who comes on site to the Rec Department be required to undergo <br />background checks. Legislation will be passed to address that particular issue. But even <br />in the absence of that legislation, it was decided to put that requirement into this contract. <br />The committee recommended the legislation be held in committee until amended. The <br />contract was presented tonight to City Council as amended. It will be passed under <br />suspension of the rules this evening so that Mr. Marshall can be paid for his services <br />since July. <br />AUDIENCE PARTICII'ATION <br />Tom Herbster, 4965 Porter Road <br />^ Asked for clarification because the speech he prepared may have been taken off the <br />table by the Mayor and his staff. Is there still a proposal to cut the work hours? He <br />will then amend those out of his speech. Mr. Miller asked, for the record, what was <br />the answer to his question. Mr. Herbster said a shake of the head no. Mayor said he <br />didn't think there ever was a proposal. Mr. Herbster said there was a proposal in <br />writing that came to the unions requesting atwo-hour reduction. Mayor Musial said <br />it was aconsideration-one method of reducing costs. That particular proposal has <br />been withdrawn, as he understands it, through the distribution to AFSCME <br />employees. <br />^ Mr. Herbster said he was here to refer to the rest of the proposal. AFSCME has asked <br />several times, as far back as August, to sit down with the city to discuss cost-cutting <br />measures. They finally were granted that meeting and came forward with only issues <br />that pertain to their union. They tried to take the high road and not to ask to have <br />anything taken away from anybody else. After several attempts, the meeting finally <br />came to fiuition. They discussed areas that could be cut this year in order to maintain <br />14 <br />
