The project is <br />' almost over, so when will Kennedy Ridge be repaved? <br />^ He understands there is an ordinance about placing signs on tree lawns. They had a <br />garage sale and the city picked up his sign which was placed on the tree lawn. The <br />sign was returned. Why is this ordinance on the books? Other cities don't have it. <br />Should be able to place signs on the tree lawn without irverference from the city. <br />• The speed limit on Country Club is 35 mph from Columbia Road to Great Northern <br />Blvd., and then 25 from Great Northern to Lorain. Why? <br />^ RTA Park-and-Ride. There was a drawing that showed trees, shrubs and sprinkler <br />systems. He doesn't see them putting sprinkler systems on the outside of the wall. <br />Are they going to do that? <br />Councilman Gazeau said he could not comment on the sprinkler system, but can comment <br />on trees. He recently drove by the Pazk-and-Ride and dcesn't recall the site looking on <br />the plans how it looks now. There aze not a lot of trees left. He recalls some screening or <br />buffering where the entry access comes in and that there would be something left by way <br />of vegetation. It appeazs that everything is gone. All you see is the wall-not a tree left <br />standing. He would like somebody to bring it up to RTA. He shares Mr. Meder's <br />concerns. A close eye should be kept on this to make sure what occurs is what was <br />represented. <br />Law Director Dubelko commented on placing signs in the right-of--way that, generally <br />speaking, the right-of--way is for vehicular and pedestrian traffic and the city tries to <br />minimize the amount of signage in the right-of--way to those that direct traffic. There are <br />also liability issues if the city authorizes the placement of signs in the right-of--way that <br />could cause injury. There have been issues in the past that have resulted in litigation in <br />court where cities have been held liable for creating nuisances in the right-of--way. We <br />don't place things in the right-of--way. We attempt to minimize it to the greatest extent <br />that we can to keep it open and free for vehiculaz and pedestrian traffic. <br />Councilman McKay said he did contact the Building Dept. in regard to the sprinklers. <br />After they reseazched the minutes of the committees, they could find no mention of <br />sprinklers in any of the meetings or in the motions to approve. However, if they're going <br />to have green grass on the outside, they're probably going to have to put in sprinklers. <br />Councilman Nashar noted, with regazd to the sign in the right-of--way, that the city most <br />times won't arbitrarily come out and pick it up. That had to be as a result of a complaint. <br />Councilman Dailey noted that Olmsted Falls also has laws against placing signs in the <br />right-of--way. <br />Councilman Gazeau said this is the first he has heazd about the repaving of Kennedy <br />Ridge. It was not preserved to Council as a capital improvement for this year or next <br />year. If the road was damaged by virtue of vehicles related to the Park-and-Ride <br />construction, we should look to the entity who damaged the road. We were concerned <br />11 <br />
