Council Minutes of 10/1/2002 <br />these officers. There will not be a large influx of employee applications to the City of <br />North Olmsted due to these benefits. These people are serving their country. <br />Resident Paul Barker stated that the companies he does business with are doing <br />nothing in these situations due to the setting of a precederrt in case something gets <br />tied up forever. Mr. O'Grady asked if vacation time was due the affected people if <br />they were gone for two years or more overseas. Mrs. Copfer answered that it has <br />been. Mr. Limpert made a motion to hold the ordinance in committee until more <br />information is received. Mr. McKay seconded the motion, and the committee passed <br />it 2-0. Chairman McKay requested that the Finance Director and the Safety Director <br />make recommendations in regard to the benefits. Also, the Westlake ordinance is to <br />be supplied to Council. <br />^ Ordinance 2002-141, an ordinance authorizing the Mayor to sell certain property <br />from the James Lumber property, now owned by the city, to-wit: a flag pole and <br />declaring an emergency. Mr. Limpert stated that this is the flag pole that used to <br />stand in front of James Lumber and was removed and driven away. The Mayor stated <br />that the person who cut down the flag pole was under the impression that he had <br />permission from the former Service Director to remove the flag pole. Also, the <br />Mayor indicated the Law Director said Cauncii should be the body to pass legislation <br />to receive compensation for the pole. Mr. Gareau asked the Mayor if any discipline <br />action had been taken. The Mayor stated that the former Service Director had taken <br />no disciplinary action. The person thought that he had permission to remove the pole. <br />Mr. Gareau asked if anything else was removed from the building. The Mayor <br />answered not to his knowledge. Also, it was brought up that the Police Department <br />escorted the pole in question to its present location. The Law Director presented <br />three options: request the Police Department to investigate the issue; let the Law <br />Department seek recovery of the pole; or let the Council pass this ordinance to <br />recover the value of the pole, which is $125. Mrs. Kasler does not want an <br />investigation, but is not comfortable with condoning this action by supporting the <br />ordinance. The chairman asked if Council warited to continue with this legislation or <br />turn the matter over to the Law Departmerrt. The Law Department has no problem <br />with handling the problem. Mr. Miller asked what if another person had wanted the <br />pole. There was no answer given. Mr. Gateau stated how does someone feel that <br />they are entitled to take the pale and what has been done to insure this never happens <br />again. It seems like nothing has been done, and it's okay to keep the pole for $125. <br />Mr. Nashar said he had no problem with the city recovering the $125 for the pole. A <br />vote of Councilpersons in support of the ordinance was 1 abstention, 4 yeas, 2 nays. <br />Two members of the committee recommended approval of Ordinance 2002-141, and <br />one committee member did not recommend approval. Subsequent to this discussion, <br />the Mayor sent a memo to Council noting the conditions that were set up by the <br />former Service Director which stated that under no circumstances was anybody to <br />remove any city property or any items from city property. <br />Councilman Miller asked to add to Mr. McKay's report by noting that, during the <br />discussion regarding the flag pale, the question was asked whether or not city equipmem <br />or vehicles were used in removing the pole.
