Also, zero foot candles at the lot lines will be required. <br />After the discussion, the committee unanimously recommended approval of Linder & <br />Associates, located at 4958 Dover Center Road, subject to the recommendations of <br />various boards and commissions of the city. Councilman Nashar moved far approval <br />of the construction of the building for Linder & Associates subject to the <br />recommendations of the boards and commissions. The motion was seconded by <br />Councilman McKay. Roll call: Nashar, yes; McKay, yes; Miller, yes; Gareau, yes, <br />commerning that an adjacent property owner had raised the issue of not having <br />received notice of the hearings before the Planning Commission and BZD. That <br />gentleman attended the caucus meeting this evening to discuss concerns he had with <br />the project. The property developer, Mr. Khoury, was also in attendance to discuss <br />their differences. The problem centered around a pine tree that is currently there and <br />the three pin oak trees which are to be planted. The gentlemen came to a consensus <br />on what they could do to resolves their differences and it seemed that the notice <br />requirement that may have been violated was no longer relevam. Roll call continued: <br />Dailey, yes. The motion passed unanimously. <br />Councilman Limpert, chairperson of the Environmental Corrtrol Committee: 1) The <br />committee met on September 24. Present were committee members Limpert and Dailey; <br />Presidem of Council O'Grady; Council members Miller, Nashar, McKay and Gareau; <br />Mayor Musial, Barry Boehnlein from the Wastewater Treatment Plant, City Engineer <br />Paul Deichmann, Law Director Jim Dubelko and Finance Director Carrie Copier. The <br />committee discussed Ordinance 2002-142, an ordinance to enter into a joint funding <br />agreement with the Department of Interior for a realtime gage for measuring water levels <br />in the Rocky River. The total cost is $1,500, which will be paid in quarterly installments. <br />The information gathered by the realtime gage will provide invaluable information <br />should the city have any future problems regarding by-passes or other EPA issues. Bath <br />committee members present recommended approval. <br />Councilman Miller, chairperson of the In;ra-Governmental Relations and Legislation; <br />bong-Range Planning Committee: 1) The committee met on September 24 with <br />committee members Kasler, Gareau and Miller in attendance. The committee discussed. <br />Resolution 2002-143, a resolution which recognizes the second anniversary celebration <br />of the Northeast Ohio Public Energy Council. Since the members of NOPEC serve at no <br />compensation, it was felt that a resolution would be preferred over a simple thank you <br />Letter or card. At Councilman Limpert's request, it was agreed that the emergency clause <br />would be removed and the resolution would be passed under suspension of the rule in <br />order to get timely delivery of this resolution to NOPEC. <br />Councilman Gareau had no committee report but noted that he and the other Recreation <br />Commission members had been contacted and asked to provide a new meeting date. <br />Hopefully, once this date is agreed upon there will no longer be problems of not have a <br />quorum at the commission meetings. <br />8 <br /> <br />
