Council Minutes of 9/3/2002 <br />. commeming on behalf of all that Section 533.05 was recently declared unconstitutional <br />'~ by the Ohio Supreme Court. As a point of order, Law Director Dubelko noted that the <br />state statute, upon which our ordinance is based, had been declared unconstitutional. Roll <br />called continued: Dailey, yes; Kasler, yes; Nashar, yes; McKay, yes. The motion passed <br />unanimously. Ordinance No. 2002-135 adopted. <br />Ordinance No. 2002-136 was introduced and placed on first reading by Councilwoman <br />Kasler. An ordinance amending Section 337.27 of the Traffic Code of the City of North <br />Olmsted, entitled "Drivers and Passengers Required to Wear Seat Belts; Penalty," so as <br />to make violations of the ordinance a primary offense, and declaring an emergency. <br />MISCFi.r.Atv~;OUS BUSIlYESS <br />President O'Grady announced that there would be aCommittee-of--the-Whole meeting at <br />6:30 p.m. on Tuesday, September 10. <br />Mrs. Kasler scheduled a Public Safety Committee meeting for Tuesday, September 10, <br />following the Committee-of--the-Whole to discuss Ordinance 2002-136. The Safety <br />Director and, if she deems necessary, a representative from the Police Department are <br />asked to attend. The committee will also discuss the military Leave benefits legislation, <br />2001-146. When amended, the legislation will be heard in the Finance Committee. A <br />liquor permit will also be discussed. <br />Mr. Nashar scheduled a BZD Committee meeting for Tuesday, September 10, <br />immediately following the Public Safety Committee. The committee will discuss <br />Ordinances 2002-128 through and including 2002-133. The City Engineer and the <br />Building Commissioner are asked to attend. Mr. Gareau asked if the True North gas <br />stations (Shell) could be discussed, and Mr. Nashar agreed. <br />Mr. Miller scheduled a Legislative Committee meeting for Tuesday, September 10, <br />immediately following the BZD Committee to discuss Ordinance 2002-134. Human <br />Resources Director Copeland and members of the CDBG Committee are asked to attend. <br />Mr. Limpert asked if the issue of recognizing September 11 on a yearly basis could be <br />discussed in the Legislative Committee. The research he has been finding shows that <br />even Pearl Harbor Day is taken year by year. Mr. Miller consulted with the Law Director <br />as to whether this could be discussed as the resolution recognizing Safety Forces Day <br />every year had already been passed. The Law Director said it would be proper to look at <br />legislation that has already been passed. The legislative process can be started in <br />committee. Mr.lVfiller agreed to add the issue to the committee agenda. <br />With the agenda being completed and there being no further business to come before <br />Coufi~il, President O' ~ , y adjowned the Council meeting at 10:1/7~p.m. <br />arbara L.
