Council Minutes of 9/3/2002 <br />., Law Director Dubelko: 1) Regarding the mayor's court initiative of Councilwoman <br />Kasler, on August 20 he met with her and the Mayor to discuss the matter. The Law <br />Department has been conducting research since that date, and he will soon be distributing <br />legal memos regarding some of the concerns raised by the Rocky River Municipal Court. <br />2) On August 21, he met with Councilman Gateau and Building Commissioner Conway <br />regarding the two pending lighting ordinances (99-77, 99-79) which were sponsored by <br />Councilman Gateau. It was a very productive meeting of looking into model lighting <br />ordinances from other communities and seeing whether or not some of those provisions <br />can be incorporated into the two pending ordinances that are before Council. On August <br />28, Commissioner Conway provided him with a memo containing recommendations of <br />what additionally should be included in these ordinances. He will review those <br />recommendations and provide the BZD Committee with the proposed amended versions <br />of the ordinances. <br />3) He participated in the Homecoming parade on August 25 for the first time as an <br />elected official. It was a very nice event with a lot of harmony and goodwill. <br />4) On August 26, the city's law clerk Steve ICnippen completed his summer clerkship <br />with the Law Department. He did an excellent job working approximately 35 hours a <br />week for the Law Department, and he is now on a part-time schedule. Steve did a <br />particularly good job of researching the city's community access ordinance, the mayor's <br />court initiative and the pending city right-of--way ordinance. <br />5) On August 26, he received a request for information from Councilman Miller <br />regarding the program audit meetings which were held by the city's directors in the latter <br />,~ half of July. He was not able to respond before Council voted on the budget ordinance at <br />the special Council meeting that evening, thereby making the request moot. <br />6) On August 26, he attended the Board of Control meeting at which a contract was <br />approved for the demolition of the homes on the library site. On August 27, he worked <br />with the mayor's administrative assistant in finalizing the drafting of the actual contract. <br />The contrail has been submitted to the Mayor's office. <br />7) On August 27, he provided the Finance Director with a memo on the legal issue of <br />whether the city must credit current employees with accumulated sick leave earned in <br />other Ohio political subdivisions. The simple answer to that question was yes. <br />8) On August 17, he prepared the contract for the Police Department's purchase of <br />weapons. Council had authorized the bidding for that contract earlier in the summer. <br />9) On August 28, he received a request for a legal opinion from Councilman Gateau <br />concerning the duties of the President of Council. He will provide a legal opinion on that <br />issue within a week after giving the President of Council an opportunity to have input. <br />10) On August 29, he attended a seminar in Columbus sponsored by the Ohio Municipal <br />League regarding S. B. 255. This recently enacted Senate bill creates new right-of--way <br />legislation regulating what municipalities can regulate for the use of thew rights-of--way <br />by utility companies and cable companies. In the near future, he will be providing a <br />memo to the committee that is currently considering the pending right-of--way ordinance. <br />The memo will outline S. B. 255 and make recommendations regarding that pending <br />ordinance. <br />11) On August 30, the Law Department received notice from the Cuyahoga County Court <br />of Appeals that it had dismissed the appeal filed by the defendant in the case of City of <br />"~ North Olmsted vs. Terrence Reagan. Mr. Reagan had been convicted of a disorderly <br />
