Council Minutes of 9/3/2002 <br />Mayor Musial responded that the city cannot prevent residents from leaving objects <br />scattered on their front lawns or from letting weeds grow in the backyard as opposed to <br />grass. With regards to the tree lawns that are renovated because of the trenching that took <br />place with the lights, this is a situation where the city is embroiled in a controversy with <br />the surety company as the contractor has gone bankrupt and is not available to do the <br />repairs. The issue is in the hands of the Law Department. With regards to the one lamp <br />pole that has not been connected, that has been called to the attention of CEI and will <br />hopefully be taken care of soon. It is true that snow plows do sometimes damage streets, <br />especially when there is a protrusion above the street. The city does have some <br />difficulties associated with the monies required to do slab repair in these pasticulaz azeas. <br />Regarding the development referred to as the companion developmem, the former <br />Service Director elected to start on that development on the north side and work south to <br />it. The other aspect involving the continued deterioration of the streets through use of <br />cold patch treatment is something that will have to be kept up with until the funds to take <br />care of the streets are available. Mrs. Kasler asked if there was a surety bond which <br />would allow for the continuation of the work. Law Director Dubelko answered that this <br />was turned over to the Law Department about six weeks ago. They had to follow the <br />process of the surety bond in declaring the contract to be in default. When the contractor <br />didn't respond, then the surety was requested to fill its obligations under the bond. <br />Currently, discussions are taking place as to who hires the contractor-the surety or the <br />city. It is the city's opinuon that the surety should do it. If the city has to hire the <br />contractor, then it would have to go through the city Board of Comrol and possible <br />bidding. Hopefully, this will be completed in September. Councilman Miller noted that <br />he lived in the adjoining development and his street is still filled with the same cold patch <br />that gets kicked up. His street connects the two developments and was not done, nor was <br />a portion of Edgepark which is basically a through street from Porter to Dover Center. <br />Previously, he had urged Council to follow the plan of the fornner Service Director that <br />the work would start at the north end of Dover Center and work south. However, last <br />year the job was pulled right where he lives. Mr. Limpert, chairperson of the Streets & <br />Drainage Committee, commented that he would love to have all these streets addressed, <br />but it takes funding. This will be a discussion for the appropriations process. Mr. Gareau <br />asked, with regard to the breach of contract, if the discussion was limited to the <br />maintenance and restoration of the right-of--way. He has noted that many of the recently <br />installed street lights are not straight they are leaning. Mayor Musial said that was a <br />goad point, and it would be called to the attention of CEI. He noted that street work to be <br />done this year includes Brendan Lane, finishing the remainder of Edgepark Drive and <br />Pine Circle and accompanying streets, providing $150,000 to the Sandy Ridge <br />development to start work there and providing $150,000 to the flower streets. Mr. Miller <br />said he hoped that the city goes forwazd with streets that are on the eligibility list before <br />adding an other streets and gassing over those that were on the list. He noted, regarding <br />the streets referred to in the letter, he had r~uested that those streets be kept on the list as <br />they had been in previous years. Finance Director Copfer said that the streets to be <br />repaired are named in the borrowing legislation. It was agreed that this issue would be <br />discussed at length in a Streets & Drainage Committee meeting. <br />9 <br />
