Council Minutes of 6/4/2002 <br />~ Law Director Dubelko: 1) On May 22, he attended a Step 3 grievance hearing held by <br />the new Personnel Director. She is doing a good job, especially with respect to that <br />particular hearing. The grievance involved an ordinance which this Council had adopted <br />reorganizing in part the Service Department to transfer three storm sewer workers down <br />to the Wastewater Treatment Plant. <br />2) On May 22, he provided a memo to the Mayor and members of Council regarding <br />Adelphia and WideOpenWest's decision to terminate franchise fees on cable modem <br />service revenues based upon a FCC ruling. Since that time, he has formally put each of <br />these companies on notice that the city will expect back paymern of those fees in the <br />event that a court of competent jurisdiction overturns that FCC ruling. There are some <br />actions that are in the works to be filed by municipal organization groups. <br />3) On May 23, he provided advice to the Safety Director regarding the legality of the <br />city's current rental agreement with the Southeast Golf Cart Company. <br />4) On May 23 and May 30 he met with the Finance Director and the Environmental <br />Engineer to put together an amendment to the Fairview Park sewer capital improvement <br />contract for projects during the period 1992 to 1997. Ordinance 2002-89 is before <br />Council this evening. <br />5) On May 24 he provided to Council a memo regarding the proposed RFP process for <br />personal service contracts. This was in response to questions by Council member Kasler <br />and other members of Council regarding legality and origins of this new process, <br />particularly as applied to several pending ordinances before Council recently. Also, he <br />addressed this issue before the Legislative Committee on June 3. <br />6) On May 28, the new city law clerk started, and he is doing a good job. He is working <br />on a second community access ordinance which would deal with regulating city signs, <br />announcements on cable TV channels and the links that are permitted pursuarn to policy <br />on the city's website. Hopefully, an ordinance will be ready for presernation to Council <br />after their vacation. <br />7) On May 28, he met with city planner George Smerigan and Assistant Law Director <br />Bryan O'Malley prior to the Planning Commission meeting to discuss issues relating to <br />the future rezoning of Parcel E. Mr. Smerigan made a presentation to the Planning <br />Commission that night. The Planning Commission has scheduled a work session on June <br />11 to discuss the rezoning of Parcel E. Hopefully, after Council's vacation, there will be <br />an ordinance presented to Council recommending rezoning of that parcel. <br />8) Before Council this evening is Ordinance 2002-91 which authorizes the expenditure of <br />funds to purchase one of the two pieces of property that the city needs to acquire for the <br />proposed roadway to the future RTA Park-n-Ride facility. Hopefully, an ordinance <br />involving the purchase of the remaining parcel of land will come before Council before <br />their vacation. <br />Regarding cable companies Adelphia and WideOpenWest, Councilman Nashar suggested <br />that, if negotiations were being started, that they be asked to provide discounts for senior <br />citizens. Law Director Dubelko said that was a good idea, but the contract is not <br />scheduled for renewal until 2011. If Adelphia's operations are transferred to another <br />entity because of their possible bankruptcy, the city may get an opportunity to talk with <br />the new potential franchisee. <br /> <br />4 <br /> <br />
