Council Minutes of 4/16/2002
in fact accurate? President O'Grady noted that the minutes accurately reflect what was
said. However, the content of what was said was inaccurate. Do we have a responsibility
to add additional information? Law Director Dubelko answered not legally. Councilman
Gareau made a motion to approve the minutes as written, and the motion was seconded
by Councilwoman Kasler. President O'Grady said he would not accept the motion at this
point. Councilman Gareau asked Presider O'Grady to call the question. Mr. O'Grady
said that Mr. Gareau was not recognized. He said the question being discussed was one
of two that he knows of that will be considered with these minutes. Councilman Gateau
asked to be recognized. President O'Grady refused to do so as the Mayor wanted to
make remarks, and he will call on other people when the Mayor has concluded.
Councilman Gareau challenged the decision of the chair, second by Councilwoman
Kesler. Roll call on whether the decision of the chair to not recognize Mr. Gateau should
stand: Gateau, no; Kesler, no; Dailey, yes; Limpert, yes, commenting that he stands with
the chair as he has said Mr. Gareau will be recognized when the Mayor completes his
remarks. Roll call continued: McKay, no; Miller, no; Nashar, no. The decision of the
chair was not sustained, and Mr. Gateau was recognized. Mr. Gareau moved that the
minutes be approved as written; second by Mrs. Kesler. President O'Grady said he had a
poim of order in that he had a correction to the minutes. Mr. Gateau withdrew his motion
and Mrs. Kesler withdrew her second. Mr. O'Grady said, before he made his correction,
he would like to continue the business of allowing the Mayor to comment and asked if
there was an objection. Mr. Gareau said there was and moved that the minutes be
approved as written. The motion was seconded by Mrs. Kesler. Roll call: Gareau, yes;
Kesler, yes; McKay, yes; Miller, yes; Limpert, said he had brought the question up
because there was a question of accuracy. He can see it's going to become immaterial;
and, in the interest of harmony and moving along, he will vote yes. Roll call continued:
Dailey, no; Nashar, yes. The minutes of the meeting of Apri12, 2002 were approved as
written. President O'Grady suggested that there was an inaccauacy in the minutes on
page 12 in the reported comments of Mr. Bob Ralph. On the fourth line it reads, "He
read from Mr. O'Grady's previous campaign literature where he talked about..." In fact,
it was not stated by Mr. Ralph that that was campaign literature. The article Mr. Ralph
was referring to was how Council Members at Large can work with Ward Council
Members to accomplish good things for Council. It was not in campaign literature but
was in a ward newsletter put out by Mr. Dailey.
~S,PECLA~. LEGISLATION
Resolution No. 2002-58 was introduced and placed on first reading by Councilman
Gateau on behalf of himself, the Mayor and entire Council. The motion was seconded by Councilman Limpert and passed
unanimously. Councilman Gateau moved for adoption. The motion was seconded by
Councilman Limpert and passed unanimously. Resolution No. 2002-58 adopted.
President O'Grady invited Nicholas and his father to come forward. The resolution was
read in its entirety.
