Council Minutes of 4/16/2002 <br />Presidern O'Grady made the following announcemerns: Resolution 2002-58 and <br />Ordinance 2002-17 will be passed under suspension of the rules; special Council <br />meetings will be held at 6:45 p.m. on Tuesday, April 23, and Tuesday, April 30, for <br />consideration of the capital improvements ordinances, 2002-54 and 2002-55; the next <br />regularly scheduled Council meeting will be held on Wednesday, May 8, due to the <br />primary election on Tuesday, May 7. <br />PO TS <br />Mayor Musial: 1) The Inswance Services Office of the State of Ohio, in cooperation <br />with Building Commissioner Com~vay, completed the analysis of the city building codes. <br />The classification runs from one to ten. In 2000, ow classification was seven and has <br />improved to two in 2002. The Inswance Services Office is an inswer-supported <br />organization, and their primary mission is to provide advisory insurance underwriting and <br />rating information to insurers. The increase in the classification to a two level may result <br />in reduced insurance costs for the residems of North Olmsted with regards to real <br />property values. He is very proud of that and gives credit to Dave Conway and his <br />excellent Building Department for accomplishing this particular achievement. <br />Law Director Dubelko: 1} On Apri16, the Law Department received a decision from the <br />Eighth District Court of Appeals in the case of North Olmsted vs. Banning. It affirmed a <br />conviction of a DUI defendarn and upheld the legality of an arrest made by North <br />Olmsted Police Officer Jack Butcher. Assistant Law Director O'Malley offered the city's <br />appellate brief in that case. <br />2) On April 8, he attended a meeting of the Landmarks Commission to swear in <br />Council's appointee Joe Lang. <br />3) On April 9, he provided the Mayor, Council and the Board of Control with legal <br />opinion No. 10 which discussed the respective powers of Council and the Board of <br />Cornrol over the city contracting and approval process. <br />4) On April 9, the city received notice of a favorable award in a fire fighter arbitration <br />case involving the subject of whether, under the collective bargaining agreement, fire <br />fighters who attend training classes on holidays should receive holiday pay. The <br />arbitrator decided fire fighters were not entitled to that additional pay under the current <br />collective bargaining agreement. The arbitration was handled by Assistant Law Director <br />O'Malley. <br />5) On April 10 and April 11, he conducted negotiations with attorneys for the property <br />owners whose properties are being sought for the proposed roadway to the new RTA <br />Park-n-Ride facility. He also completed negotiations with RTA for the agreement in <br />which RTA will reimbwse the city for the costs of acquisition. That ordinance is before <br />Council tonight on third reading; arKl, if Council adopts the ordinance, he expects to file <br />appropriations action within the next week. <br />6) On April 11, he participated in a DARE mock-trial at St. Brendan's Elementary School <br />along with Assistant Law Director O'Malley and Council Member Kasler. He presided <br />as the judge at that mock trial, Mr. O'Malley was the prosecutor, and Mrs. Kasler was <br />defense counsel. It was a fascinating trial. Depending on who you talk to, Mrs. Kasler or <br />~"' Mr. O'Malley, one or the other may claim victory! <br />3 <br />
