Roll call continued: Kesler, yes; Limpert, no, with <br />comment that this issue is being addressed in the form of a charter amendmern. <br />Ordinance 2002-20 was passed tonight to put this issue before the vote of the people. <br />Most of Council voted for 97-122. He is hoping that this will not be under suspension of <br />the rules so it can be reviewed in committee and perhaps reason will be thought that we <br />can allow the pimple to use their judgment and vote either up or down when this goes <br />before them on the ballot and not have Council prejudice it by passing it, or repealing this <br />ordinance first. Roll call continued: McKay, yes; Miller, yes, with commern that, when <br />he voted for 97-122, he did not anticipate that it would be misused in the way in which it <br />was. That is why he feels it is important to repeal that ordinance. Roll call continued: <br />Nashar, yes; Dailey, yes. The mofion passed with six yeas and one nay. Councilman <br />Gareau moved for adoption; second by Councilwoman Kesler. Roll call: Gareau, yes; <br />Kesler, yes; Dailey, no; McKay, yes; Limpert, no; Miller, yes; Nashar, yes. The motion <br />passed with five yeas and two nays. Ordinance No. 2002-51 adopted. <br />Ordinance No. 2002-52 was introduced and placed on first reading by Councilman <br />Gareau on behalf of himself and Councilwoman Kesler. An ordinance amending <br />Sections 351.04 and 351.20 of the Traffic Code in order to remove from Chapter 351 <br />duplicative provisions relating to handicapped parking violations and provisions which <br />properly belong in Chapter 11 b 1 of the Zoning Code, and further to bring the substarnive <br />provisions of Section 351.20 up to State Code, amending Ordinance Number 2001-127 so <br />that it is consistent with the foregoing changes to Sections 351.04 and 351.20; and <br />declaring an emergency. <br />Ordinance No. 2002-53 was introduced and placed on first reading by Councilwoman <br />Kesler on behalf of herself and Councilman Gareau. An ordinance creating new Section <br />1161. I6 of Chapter 1161 (Offstreet Parking and Loading) of the Zoning Code providing <br />for the establishmern and maintenance of handicapped parking spaces on properties <br />zoned General Retail Business District or Mixed Use District. <br />M[ILI,~ANEUUS BUSINESS <br />Presidern O'Grady noted that he had mentioned during caucus that Ordinance 2002-53 <br />would go into the Safety Committee, but it should properly be in BZD as it is a change to <br />the Zoning Code. Mr. Nashar agreed to take it into the BZD Committee. Based on the <br />recommendation of the Law Director, Ordinances 2002-41 and 42, will be placed into the <br />Intra-Governmental Relations and Legislation; Long-Range Planning Committee. Mr. <br />Miller agreed to do so. <br />Mrs. Kesler asked to register her votes on the legislation from the meeting of March 19 <br />when she was absent. On 2001-131, yes; 2002-12, she is not eligible to vote because the <br />outcome cannot be changed; 2002-21, 2002-22, 2002-23, 2002-24, 2002-25 are yes. <br />Ordinances that were under suspension, 2002-31, 2002-32 and 2002-36 are yes to <br />`'' suspension and passage. <br />,moo <br />18 <br />~.. ~ , <br />
