Council Mieutes of 4/2/2002 <br />of a service building to house wireless telecommunications equipmem associated with the <br />use of the monopole, and declaring an emergency. <br />Ordinance No. 2002-41 introduced by Councilman Gateau was given its second reading. <br />An ordinance amending Sections 533.07 of the General Offenses Code in order to <br />maximize the possible penalties for the offense of public indecency. <br />Ordinance No. 2002-42 introduced by Councilman Gateau was given its second reading. <br />An ordinance amending Section 533.05 of the General Offenses Code to define the <br />offense of importuning in gender neutral terms. <br />Ordinance No. 2002-48 was introduced and placed on first reading by Mayor Musial. An <br />ordinance designating the revenues derived from the co-location of Sprint PCS on the <br />AT&T monopole at Claque Park, and declaring an emergency. <br />Ordinance No. 2002-49 was itrtrodueai and placed on first reading by Mayor Musial. An <br />ordinance authorizing the Director of Public Safety to dispose of certain surplus <br />groundskeeping equipment owned by the city and formerly-used at Springvale, to-wit, a <br />1990 RU 450 D Fairway Mower, 1990 Toro SP 14 Sand Rake and 1988 Toro GMS <br />Greensmower, by trading in the said surplus equipment and receiving a credit of <br />$15,985.00 against the price of new groundskeeping equipmern, and declaring an <br />emergency. Mayor Musial said it appears that Springvale will open on time as <br />determined to be Memorial Day, and this involves the leasing of new equipment that <br />would be necessary to handle the needs of Springvale. Councilman Limpert moved for <br />suspension of the toles requiring three readings and committee review. The motion was <br />seconded by Councilman Gateau and passed unanimously. Councilman Limpert moved <br />far adoption; second by Councilman Gateau. Roll call: Limpert, yes; Gateau, yes; <br />Nashar, yes; McKay, yes; Kasler, yes; Miller, yes, with comment in regard to the <br />comment that the Mayor made about opening Springvale on time. Springvale is <br />projected to open soon; however, it's not opening on time because of the project for <br />improvement that is involved. Roll call: Dailey, yes. The motion passed unanimously. <br />Ordinance No. 2002-49 adopted. <br />Resolution No. 2002-50 was introduced and placed on first reading by Mayor Musial on <br />behalf of himself and the entire Council. A resohrtion authorizing the Director of Public <br />Service to advertise for bids for water main cleaning, repairing and relining and other <br />improvemetrts at Summerland Avenue, Virginia Avenue, MacBeth Avenue anal Esther <br />Avenue as detailed in the plans and specifications on file and authorizing the Mayor to <br />contract for the same, and declaring an emergency. <br />Ordinance No. 2002-51 was introduced and placed on first reading by Councilman <br />Gateau on behalf of himself, Councilwoman Kasler and Councilmen Miller, Nashar and <br />McKay. An ordinance repealing Ordinance 97-122 entitled, "An ordinance creating a <br />new Chapter 133 of the Administrative Code of the City of North Olmsted, entitled <br />`Interim Director Appoirnmerns,' and declaring an emergency," and declaring an <br />emergency.
