Council Minutes of 4/2/2002 <br />5 days of sick leave for Officer Rayner who will be returning to duty very shortly. <br />The motion was seconded by Councilman Miller and passed unanimously. <br />• An incident which occurred at the Recreation Center on March 9 related to the use of <br />the defibrillator. The Safety Department explained that a man entered the Rec <br />Center, had what appeared to be a cardiac incident and the EMS squad was <br />dispatched and arrived within two to throe minutes. Unfortunately, the gentleman <br />passed away. However, there was an issue on an electronic defibrillator which is <br />present at the facility, but was either not accessible or unable to be accessed by the <br />staff at that time. The is~e before Council, however, is a concern about the policy <br />and training regarding this equipment and ensuring that the equipment is not only <br />accessible but that all employees are properly trained. The committee was assured by <br />the administration that all part-time and full-time employees will receive training (if <br />they have not already received training) in regard to this defibrillator, the use, the <br />accessibility, the availability, the location of the defibrillators at both Springvale and <br />the Rec Center. Notices have been provided to all employees to that effect. Also, <br />there will be a glass cabinet purchased, similar to what is available for fire <br />extinguishers, where that can be broken and that then is easily accessible for use. <br />Council has suggested that this same type of glass case be considered for the other <br />facilities that have defibrillators. Mr. Miller made an additional request for a logo or <br />sign that designates what the equipment is used for-something that can be quickly <br />seen by anyone in the building, whether it be an employee or member of the public- <br />so that it is easily and universally recognized as a defibrillator location so that they <br />can also be of assistance should that be necessary. Special accommodations or <br />considerations will need to be made with regard to the Senior Center since that is <br />attached to the Community Cabin and there is a differemial in hows. A further <br />suggestion was made that all employees take advantage of the CPR training that is <br />offered by our Fire Department. The question of liability on the part of the city was <br />presented to the Law Department for their review. <br />• Ordinance 2002-41, which is an ordinance amending Section 533.07 of the General <br />Offenses Code in order to maximize the possible penalties for the offense of public <br />indecency. This was recommended by Councilman Gareau and it in effect removes <br />the requirement that a person be convicted of multiple offenses before the punishment <br />arises to a first degree misdemeanor. The legislation will raise it to a first degree <br />misdemeanor on the first offense, and the committee believes that the first offense is <br />the most serious. The committee recommended approval of Ordinance 2002-41 <br />unanimously. <br />• Ordinance 2002-42, an ordinance amending Section 533.05 of the General Offenses <br />Code to define the offense of importuning in gender neutral terms. Simply stated, the <br />ordinance was changed so that it is gender neutral in effect within the wording of the <br />ordinance. Law Director Dubellco noted that he had suggested that the committee <br />proceed slowly on this and not pass it in a knee jerk reaction. After the committee <br />meeting, he took a look at the definition of importuning to see if it had any particular <br />meaning, and it really simply means making a request persistently and in an <br />obnoxious manner, to continue on and on and on. The case that brought the proposed <br />change in this ordinance about was the Cleveland vs. Iv~estros case, which <br />Councilman Gareau brought to the attetrtion of Council.
