Council Miwutes of 3/S/02 <br />need to protect our community. Mr. Dailey further commerned that he did not believe <br />support of the levy was an abuse by himself and other public officials as they have not <br />used city resources to promote the levy. Mr. McKay said they he did not support the levy <br />as a Councilman because he does not know the financial condition of residents. He feels <br />that Council has enough to do taking care of city business. A councilman is elected to <br />represern everyone, those in favor and those against the levy. So, it is his position that <br />people should make up their own minds. <br />Paul Kohler, 4424 Claque Road, asked when Claque Road would be updated. Mayor <br />Musial said several years ago the money to widen Claque Road to four lanes had been <br />turned back to the county. (The residents were against the project as it would require the <br />taking of homes.) The city does not have any money in our budget, nor the foreseeable <br />budget, to fund any financing for the expansion of Claque Road from Lorain Road south <br />to Brookpark Road. Mr. Kohler said he had lived on the road for 28 years and all the city <br />has done is lift the street up and flood the sidewalks. There is heavy traffic on Claque <br />and there have been a number of accidents. Mayor Musial reiterated that, at the presem <br />time, there are no plans to do anything with regard to that road because we do not have <br />the money. <br />Don Pangrac, 23470 Sharon Drive, spoke on several questions. First, he asked if any <br />progress had been made on water rates. Mayor Musial noted that the water rates are <br />determined by the City of Cleveland. Second, he asked if the lettering on signage on <br />poles could be increased as it was difficult to read. Thud, he asked if astraight-through <br />lane (by-pass) could be constructed on Claque Road at Delmere since many vehicles <br />make a left turn onto Delmere. Fourth, he noted that the City of North Royalton has 361 <br />less students than North Olmsted and spends $7 million less to educate their children. He <br />would tike to know what is $7 million buying this community in the way of spending <br />money for an education. Mr. O'Grady noted that the city governmern is a totally separate <br />governmental agency from the schools, and we do not have oversight on their finances. <br />The school board would have to respond to that issue. Councilman Dailey responded <br />with regard to Delmere Road and noted that he had discussed that issue with the former <br />Service Director. It was his impression that, when the widening of Claque Road is done, <br />that issue will be addressed. At this time, it was not feasible to add another lane. <br />Daniel Gallagher, 5843 Chadbourne, had previously attended a Council meeting and <br />discussed a criminal trespass on his property. Councilman Miller had suggested it might <br />be a civil matter. Mr. Gallagher noted the codified ordinance section which defines <br />criminal trespass. Mr. Miller said he had commented that he wondered if it was a civil <br />matter. He is not a lawyer and does not pretend to be one. He asked if an easement <br />exists that would give the people (utilities) the right and permission to access the <br />property. Mr. O'Grady said, if perhaps there is a legal question, that Mr. Gallagher <br />submit rt in writing and Council would refer it to the Law Director for review. <br />Joseph Bouman, 23950 Gessner Road, asked the Law Director if it was legal for Mr. <br />Limpert and Mr. O'Grady, who are employees of the school board, to back the school <br />Levy. Law Director Dubelko said he felt they retain then first amendment rights to speak <br />9 <br /> <br />
