Council Minutes of 2/19/02 <br />Councilwoman Kasler, chairperson of the Public Safety, Health & Welfare Committee: <br />1) The committee met on February 11 with all members in attendance. The following <br />items were discussed: <br />A stock transfer with regard to the Harry Buffalo Restaurant, an establishment in <br />North Olmsted which holds a liquor permit. The Police Department has nothing on <br />file and no complaints at this time regarding this establishment; therefore, the <br />committee recommended that Council make no objection to this stock transfer liquor <br />permit. Councilwoman Kasler moved that Council have no objection to the stock <br />transfer for the Harry Buffalo Restaurant. The motion was seconded by Councilman <br />Miller and passed unanimously. <br />Ordinance 2002-17, an ordinance amending Sections 351.18 and 353.07 of the Traffic <br />Code in order to increase the fines for certain parking offenses. In addition to the <br />amendments represented by this ordinance, the committee discussed an additional <br />change to 351.18 which would raise the fines in that section to $15 and $25 <br />respectively. This was done at the recommendation of the Chief of Police in order to <br />maintain consistency in the ordinance and to related offenses. A further question was <br />raised in that section regarding the requirement in the old and amended ordinance to <br />file personally with the Chief of Police and sign a written plea of guilty. These and <br />other issues and questions caused the committee to hold this ordinance for further <br />review by the Law Director, the Chief of Police and an additional committee review <br />once further changes have been finalized. <br />Councilman Miller, chairperson of the Infra-Governmental Relations and Legislation; <br />Long-Range Planning Committee: 1} The committee met on Monday, February 11, with <br />all committee members present. Agenda items were as follows: <br />• Ordinance 2001-158, an ordinance creating new Section 739.05 of the Business <br />Regulation Code entitled "Retail Gas Price Regulations" for the purpose of <br />prohibiting suppliers of gasoline to the public from charging a retail price which is <br />more than ZO% higher than the average retail price per gallon in Cuyahoga County as <br />determined by the Cuyahoga County Auditor and declaring an emergency as <br />amended. A letter from Mr. Jim Burns representing the Chamber of Commerce was <br />discussed. This letter had been forwarded to the Law Department for review. The <br />first issue in the Letter to be discussed was the issue of enforceability. Various <br />scenarios were presented by Mr. Burns. Mr. Dubelko felt comfortable with the <br />enforceability of the legislation. Next discussed was the threshold of 20% increase in <br />prices which would trigger enforcement action on the retailer. It was observed that <br />rates had regularly jumped from 99 cents to $1.25 and that 20'/o seemed to be <br />unreasonably low. It was felt that 50% would be more reasonable, and the sponsors <br />of the legislation agreed. Also discussed was the issue of defining the "national <br />emergency" as described in Section 3 of the ordinance. It was agreed that a period of <br />two years from the effective date of this resolution was satisfactory as to the time <br />period that this ordinance would remain in effect.
