Council Minutes of 2/19/02 <br />,;;~ Dennis Lambert, 20557 Cazey Lane, noted that the Ohio Utilities Commission, under the <br />Ohio Revised Code, does have rules regazding utilities and access to property. He <br />believes those rules would supersede any city regulations. <br />LEGISLATION <br />Resolution No. 2002-3 introduced by Mayor Musial was given its third reading. A <br />resolution authorizing the Mayor to advertise for bids for storm sewer improvements on <br />Columbia Road as detailed in the plans and specifications on file and authorizing the <br />Mayor to contract for the same, and declaring an emergency. Councilman Limpert <br />moved for adoption. The motion was seconded by Councilman Gareau and passed <br />unanimously. Resolution No. 2002-3 adopted. <br />Ordinance No. 2001-158 introduced by Councilmen Miller and Limpert was given its <br />second reading as amended. An ordinance creating new Section 739.05 of the Business <br />Regulation Code, entitled "Retail Gas Price Regulations," for the purpose of prohibiting <br />suppliers of gasoline to the public from charging a retail price which is more than fifty <br />percent (50%) higher than the average retail price per gallon in Cuyahoga County, as <br />determined by the County Auditor, and declaring an emergency, as amended. <br />Ordinance No. 2002-14 introduced by Councilman Gazeau and Mayor Musial was given <br />its second reading. An ordinance establishing fees for programs and for the use of the <br />facilities of the Parks and Recreation Department, repealing Ordinance Number 96-114, <br />and declaring an emergency. <br />Ordinance No. 2002-15 introduced by Mayor Musial was given its second reading. An <br />ordinance authorizing the Mayor to enter into a contract for the purchase of a portion of <br />the Sunoco, Inc., property located at 23370 Lorain Road, North Olmsted, Ohio, <br />(Permanent Pazcel No. 231-12-35) for the purpose of widening Claque Road, and <br />declazing an emergency. <br />Ordinance No. 2002-16 introduced by Mayor Musial was given its second reading. An <br />ordinance authorizing the Mayor of the City of North Olmsted to enter into a letter of <br />agreement with Loca12681, Ohio Council 8, AFSCME, thereby amending the collective <br />bazgaining agreement between the City of North Olmsted and Loca12681, Ohio Council <br />8, AFSCME for the city's service unit, in order to establish the new position of, and pay <br />rate for, "Head Mechanic" in the bargaining unit; and further providing for the <br />elimination of the non-bazgaining unit position of "Fleet Manager," and declaring an <br />emergency. <br />Ordinance No. 2002-18 introduced by Mayor Musial was given its second reading. An <br />ordinance authorizing all actions necessary to effect anopt-out natural gas aggregation <br />program pursuant to Section 4929.26, Ohio Revised Code, directing the Cuyahoga <br />County Board of Elections to submit a ballot question to the electors, authorizing <br />execution of an agreement with NOPEC for such purposes, and declaring an emergency. <br />'"' Councilman McKay moved for suspension of the rule requiring three readings.
