Council Minutes of 2/6/02 <br />~ Law Director Dubelko: 1) Last Saturday, former City Prosecutor Donald Albenze passed <br />away. Don served the city 24 yeazs as the Prosecutor in the Law Department. He was <br />absolutely a fine man and an excelleirt prosecutor. He had the respect of all his fellow <br />prosecutors in the Rocky River Municipal Court District, the judges and all who knew <br />him throughout Cuyahoga County. (A moment of silence was observed in memory of <br />Mr. Donald Albenze.) <br />2) On Monday, February 3, the Law Department filed the Parcel E notice of appeal and <br />memorandum in support of jurisdiction in the Ohio Supreme Court. The opposing side <br />now has an opportunity to oppose the memorandum in support of jurisdiction. The <br />Supreme Court will probably rule within two to three months. <br />3) In accordance with the request of Council, he has participated in the initial negotiating <br />session with the city fire fighters held on February 5. Additional sessions are scheduled <br />for February 8 and Februazy 13. <br />4) Since the time of the last Council meeting, he has issued two legal opinions: 2002-05, <br />which deals with the subject of the effective date of the wazd redistricting in the city; <br />2002-06, which deals with the preemption of the city's zoning laws when they deal with <br />matters that are in the exclusive control of the Division of Liquor Control. <br />5) He has made two Law Department appoinrtments: Bryan O'Malley, Assistant Law <br />Director; Dan Ryan, City Prosecutor. They are very good appointments. Both are city <br />residents, and Dan Ryan is a long time member of the city Law Department. Bryan is a <br />long-time municipal lawyer who has worked for North Olmsted for four years and <br />previously worked for eight yeazs for the city of Westlake. <br />6) His office is still in transition. He has signed a lease, consistent with the office <br />allowance granted by Council, far Law Department offices at 26777 Lorain Road, Suite <br />416. It's a good location and close to City Hall. He and the Assistant Law Director are in <br />the process of hiring a secretary. Hopefully, by the end of the month the office will be <br />famished and the phones and computers will be installed. <br />Councilman McKay, chairperson of the Finance Committee: 1) The committee meeting <br />was held on Tuesday, January 22. Present were committee members Limpert, Kasler and <br />McKay; Council members Gazeau, Nashar, Miller, Dailey; Council President O'Grady; <br />Mayor Musial, Finance Director Copfer, City Engineer Deichmann, Law Director <br />Dubelko. Agenda items were as follows: <br />• Resolution 2002-3, which authorizes the Mayor to advertise for bids for storm water <br />improvements on Columbia Road north of Lorain and to contract for the same. This <br />had been discussed a number of times last year, and the committee recommended <br />approval. <br />• Resolution 2002-4, which authorizes the Mayor to advertise for bids for printing the <br />Spring/Summer, Autumn/Winter brochure for the Pazks and Recreation Department <br />and to contract for the same. The committee recommended approval and suspension <br />of the rules. <br />• Ordinance 2002-8, an ordinance amending the Administrative Code of the city <br />entitled "Payment of Accumulated Sick Leave Credit." This ordinance provides for <br />the payment of unused accumulated sick time and the schedule of payable sick leave <br />hours.
