°Councit Minutes of 1115/2002 <br />.,,,~, prior to his joining Council. It was and is his understanding that this ordinance was to be <br />reviewed for its effectiveness prior to being renewed and made permanent. He does not <br />feel that one conversation between Mr. Nashaz and the Chief of Police constitutes a <br />review. He was informed this evening that there were just four citations that were issued <br />under this ordinance last year. Either it worked so well that people are not using their <br />phones, or it was just unnecessary legislation. There are laws currently on the books that <br />order drivers to maintain control and minimize distractions while driving. Seeing that <br />talking on a mobile phone can be distracting, he believes that we are writing laws on top <br />of laws where they aze not needed. Roll call continued: Miller, yes; Gazeau, yes, with <br />comment that, if there was some material put forth by Mr. Dailey or other Council <br />member that was not responded to by a member of the administration or the Police Chief, <br />that could be reviewed in committee. We aze voting on this this evening for continuity of <br />the law so there would be no interruption. That is why Chief Ruple requested that we <br />pass it under suspension because it would expire before our next Council meeting. There <br />is nothing to stop us from introducing an ordinance repealing it in the eveirt that evidence <br />is brought forward to suggest that it is unnecessary. Roll call continued: Limpert, no; <br />McKay, yes. The motion passed with five yeas and two nays. Ordinance No. 2002-10 <br />adopted. <br />Ordinance No. 2002-11 was introduced and placed on first reading by Mayor Musial. An <br />ordinance authorizing the Mayor to retain Gary C. Johnson, Esq. of the law firm of <br />Johnson & Angelo, for the purpose of providing consulting services to assist the city in <br />the current collective bargaining negotiations with the International Association of Fire <br />Fighters, Local 1267, and declaring an emergency. <br />Ordinance No. 2002-12 was introduced by Councilman Gareau on behalf of himself and <br />Council Members Miller, Kasler and Nashaz. An ordinance repealing Ordinance <br />No. 97-122 entitled, "An ordinance creating a new Chapter 133 of the Administrative <br />Code of the City of North Olmsted, entitled `Interim Director Appointmerrts,' and <br />declaring an emergency," and declaring an emergency. <br />MISCELLANEOUS BUSINESS <br />President O'Grady made the following committee assignments: Resolutions 2002-3, <br />2002-4 and Ordinances 2002-8 and 2002-11 to Finance; 2002-12 to Itttra-Governmental <br />Relations and Legislation; Long-Range Planning Committee. <br />Councilman Miller scheduled an Intra-Governmental Relations and Legislation; Long- <br />Range Planning Committee meeting for 7 p.m. to conduct the boazds/commission <br />interviews. The committee will meet again immediately following the Finance <br />Committee to discuss Ordinance 2002-12. The Mayor and a representative from the Law <br />Department are asked to attend. <br />11 <br />
