Council Minutes of 1/2/02 <br />-.bti Law Director Dubelko: 1) Commented that he is beginning his duties as Director of Law <br />-.~ with positive feelings and with optimism. He advised that all government officials try to <br />do their best during their next term of office to always respect the various offices and <br />positions in the city government, ff everyone plays their own role and respects the roles <br />in government assigned to others, the city's business will be done effectively. <br />2) In the Parcel E case, the Court of Appeals on December 20, 2001 denied the city's <br />motion for reconsideration. The court also journalized its entry on the merits on that <br />date. Accordingly, the city's notice of appeal and memorandum in support of jurisdiction <br />to the Ohio Supreme Court is now due to be filed in that court on or before February 4 of <br />this year. In accordance with Council's direction, he will prepare and file a notice of <br />appeal and memorandum in that case setting forth the city's best azguments. <br />3) There are three firefighter arbitrations scheduled for this month. <br />4) In accordance with Council's authorization, he will talk with RTA and the affected <br />property owners regazding the acquisition of two parcels of land for the public roadway <br />off of Great Northern Boulevard leading to the new Park-n-Ride. <br />5) He is working on the acquisition of six other pazcels along Claque Road for the <br />widening of that road and its intersection with Lorain Road. <br />6) He has submitted his plans to the Mayor, Finance Director and the members of <br />Council regarding his proposed organization of the Law Department. There are two <br />proposed changes: First, to start the process of establishing a Law Department at City <br />Hall by providing for a transitional city Law Department this year at privately leased <br />space off-site from City Hall. Second, reorganizing the composition of the Law <br />Department so as to provide for afull-time assistant law director, apart-time prosecutor, <br />a full-time legal secretary and a part time law clerk. It is his understanding that he witl <br />have an opportunity to address these matters before Finance Committee on another date. <br />He asks that Council attend to this proposal as expeditiously as possible as he is severely <br />understaffed and underfunded on the civil side of the Law Department. <br />Finance Director Copfer: 1) Welcomed Mr. Dubelko and wished him good luck in his <br />new position. <br />2) As reported in the newspaper a few weeks ago, cities will receive a worker's <br />compensation bonus if the Finance Director and Mayor attend a seminar. She and the <br />Mayor will be attending at the end of January. However, she is unsure how the payment <br />is made. Supposedly, it is 25% of the city's premiums. But she does not know if it is <br />done as a credit. The city premium for 2001 will be paid in 2002, and she is not sure if <br />the discount will be pushed off urrtil 2003. Until she receives that information, she does <br />not know exactly how the city will be impacted. <br />Councilman Limpert, member of the Public Safety Committee: 1) As the chairperson of <br />the Public Safety Committee is now the President of Council, aCommittee-of--the-Whole <br />was held this evening at 7:25 p.m. to discuss three liquor licenses; <br />• Anew DSI license, which is spirituous liquor for on-premise consumption only, <br />beer/wine for on-premises and off-premises in original sealed containers until <br />2:30 a.m. for Ruby Tuesday Inc., 26770 Lorain Road.
