Council Minutes of 12/2/2003 <br />LEGISLATION <br />Ordinance No. 2003-87 introduced by Mayor Musial was given its third reading. An <br />ordinance authorizing the Mayor of the City of North Olmsted to enter into a letter of <br />agreement with Local 2681, Ohio Council 8, AFSCME, amending the collective <br />bargaining agreement between the City of North Olmsted and Loca12681, Ohio Council <br />8, AFSCME for the city's Clerical and Technical Unit, in order to place within the unit <br />the position of "Animal Warden," and declaring an emergency. Councilman McKay <br />moved for adoption. The motion was seconded by Councilman Nashar. Roll call: <br />McKay, yes; Nashar, yes; Miller, no, commenting that he does not believe this is the <br />proper union for this position. It is not a clerical position. If anything, it more relates to <br />law enforcement in that he has citing authority on our residents. His vote is not to be <br />taken as any exception to the work that Mr. Ward does for the city. He does an excellent <br />job. His reputation, not just within North Olmsted but the entire Westshore area, is <br />exemplary. However, he does not feel that this is the appropriate union for this position <br />and would invite Mr. Ward to look to a more appropriate union. Roll call continued: <br />Dailey, yes; Gareau, no, commenting that he would incorporate and agree and concur <br />with Mr. Miller's comments. Roll call continued: Kasler, no, commenting that she had <br />not received an answer to her question as to the origin of this request. Therefore, she <br />does not have full information which she needs to appropriately assess the legislation. <br />Also, she has questioned the wisdom, as did Mr. Miller and Mr. Gareau, with regard to <br />the union. If a change is in fact proven to be necessary and appropriate, then it seems to <br />her it should be made to have the position placed under the supervision of the Police <br />Department, the police union, the body with which this position closely works and under <br />the group that covers in his absence. This again is not in any way a reflection upon the <br />person. It is about the position and not a person. Further, it's not a union issue in her <br />opinion but rather an administrative one. Roll call continued: Limpert, yes. The motion <br />passed with four yeas and three nays. Ordinance No. 2003-87 adopted. <br />Ordinance No. 2003-123 introduced by Council members Nashar, Gareau and McKay <br />was given its third reading. An ordinance providing for the amendment of the Zone Map <br />of the City of North Olmsted in order to supplementally zone Permanent Parcel Numbers <br />235-16-008 and 235-16-009, so as to include them within the Wireless <br />Telecommunication Facilities Overlay District ("WTFO") of the City of North Olmsted. <br />Councilman Nashar moved for adoption. The motion was seconded by Councilman <br />McKay. Roll call: Nashar, yes; McKay, yes; Miller, no, commenting he believed other <br />sites should be studied more closely before amendments to the code are made. Roll call <br />continued: Limpert, yes; Dailey, yes; Kasler, yes, commenting that it is her <br />understanding that this is the initial step in a process that will lead to the substantive <br />investigation of this tower. Roll call continued: Gareau, yes. The motion passed with <br />six yeas and one nay. Ordinance No. 2003-123 adopted. <br />Ordinance No. 2003-137 introduced by Mayor Musial was given its third reading. An <br />ordinance establishing the organization and composition of the non-uniform, part-time <br />personnel of the Police Department. Councilman McKay moved for adoption. The <br />motion was seconded by Councilman Nashar. Roll call: McKay, yes; Nashar, yes; <br />Gareau, yes; Dailey, yes; Kasler, yes, noting that her comments are to be applied to <br />14 <br />
