Council Minutes of 12/2/2003 <br />^ Ordinance 2003-162, an ordinance establishing within the special revenue fund <br />group, a Land Acquisition Fund of the City of North Olmsted and directing that the <br />net proceeds received by the city from the sale of the old library building at 27425 <br />Butternut Ridge Road be paid into said special revenue fund and declaring an <br />emergency. The purpose of this ordinance is to use the money from the sale of the <br />old library building to purchase land for the city. A special fund would be set up as a <br />land acquisition fund. After much discussion, it was decided to amend the ordinance <br />to include upgrading of city owned buildings and repairs. The ordinance will remain <br />in committee until the amendment is made in an amended ordinance. <br />^ Resolution 2003-166, a resolution to approve and authorize the Mayor to enter into a <br />release agreement with Star Transport Inc. for damage done to city property and <br />declaring an emergency. This resolution will recover the damages in money from the <br />cost of damage to city property by an individual. The insurance company will pay <br />part of it, and the individual is responsible for the remainder. The committee <br />recommended approval. <br />Councilman Nashar, chairperson of the Building, Zoning and Development Committee: <br />1) The committee met on Monday, December 1. Present were committee members <br />McKay and Nashar, Law Director Dubelko, President of Council O'Grady, Councilman <br />Paul Miller, residents from Revere, Gloucester and Burns Road. Committee member <br />Gareau was unable to attend as he was attending a Recreation Commission meeting. The <br />following items were on the agenda: <br />• Ordinance 2003-123, an ordinance providing for the amendment of the zoning map of <br />the City of North Olmsted in order to supplement the zoning of Permanent Parcel <br />Nos. 235-16-008 and 235-16-009 so as to include them within the Wireless <br />Telecommunications Facilities Overlay District within the City of North Olmsted. <br />Representing Sprint Telecommunications was Dave Richards. If the land is <br />supplementally zoned, it is proposed to have a light pole approximately 75 to 80 foot <br />in height with an additional 40 foot antenna for a total of 120 feet. The proposed site <br />will be located on the Board of Education football field property. The designated <br />pole site is to be on the southwest side of the football field, south of the existing <br />bleachers. The area will be enclosed with a chain link fence with approximately 16 to <br />18 arborvitaes trees, which will be 5 foot tall. The base will be concrete <br />approximately 50 feet by 50 feet. The proposed site will be 300 feet or 400 feet away <br />from the nearest residential property line. Residents in attendance had concerns about <br />radiation from the antenna. Mr. Richards from Sprint stated that the only radiation <br />would come off of the top of the pole at 120 feet, and a person would have to be <br />about 12 to 18 inches from that antenna to have any affects of radiation, which would <br />be low level. Residents were also concerned about depreciation of their property <br />values. The pole will not have any adverse affect on their property value. The city is <br />mandated by the federal government to comply with the regulations in the Wireless <br />Telecommunications Overlay District. After lengthy discussion, the committee <br />recommended approval of the telecommunications facilities overlay district proposal <br />subject to the recommendations of the various boards and commissions of the city. <br />r~~~~ .. . <br />
