Council Minutes of 11/5/2003 <br />^ He wonders what Ordinance 2003-157 contains. He thinks several Council members <br />have a vested irrterest in the school system, and he asked the Law Director if they aze <br />eligible to vote on legislation. Law Director Dubelko said he doesn't know who Mr. <br />Pangrac is referring to. Each Councilperson has an obligation to determine if they <br />have a conflict, to bring it to his attetrtion and ask him for an opinion. He is willing to <br />talk to residents on issues, but it is contrary to his obligation to attempt to give legal <br />advice to residents. Mr. Pangrac said he wanted to see what each Councilperson's <br />position is on that particular piece of legislation and have it stated it for public record. <br />It was suggested that Mr. Pangrac attend the committee meetings on the legislation. <br />The vote on the legislation will be on the public record. <br />Patricia Deis, 26893 Sweetbriaz Drive. <br />^ Mrs. Deis noted it was interesting that Mr. Limpert felt it necessary to take a public <br />forum this evening to happen to notice her in the audience as she spent several hours <br />with him yesterday at the polls, allowing him ample time to explain his personal <br />agenda. The election is over. <br />Joseph Bowman, 23950 Lessner Road. <br />^ Thought he heazd the Mayor say the policy of installing storm sewers and covering <br />culverts which used to be free is no longer. Mayor Musial answered that formerly, if <br />a resident purchased the pipe, the city would install the pipe as time permitted. That <br />is no longer done. Mr. Bowman said that the city had agreed to install the pipes for <br />the residents of Lessner Road as had been done for W. 231 Street. The project was <br />put off a number of times, but it is a matter of public record that the city agreed to do <br />it. He was not aware the policy had been changed. Mr. Limpert, chairperson of the <br />Streets & Drainage Committee, explained that since W. 231 Street was done, the <br />federal government has installed new Phase II storm management requirements. One <br />of which is requiring a major plan of the entire city-what we have, what we plan to <br />do. They are encouraging open drainage and discouraging covered culverts along <br />side of the road. The city has to put forwazd a comprehensive plan, so it makes sense <br />to do a moratorium on this work until we have that plan together. This was not done <br />by Council as legislation, it is an administrative policy. Mr. Bowman said he <br />wondered when he and the residents of his street would get what was promised to <br />them. His comments spazked a lengthy discussion with several Councilpersons <br />agreeing that the Lessner Road residents have a legitimate complaint. Some Council <br />members asked if the federal policy dictated that no culverting should be done at all <br />while the comprehensive plan was being formulated. Councilman Miller specifically <br />asked about culverting on south Canterbury Road. Mayor Musial said that in addition <br />to the Clean Water Act, there is a question of surging taking place which may cause <br />flooding in the basements. When you insert a one foot diameter pipe in a ditch that <br />perhaps can handle a four foot diameter pipe, enclose it and contain the amount of <br />water flowing out, you may have surging taking place. There's got to be some <br />calculations to cover that aspect in addition to this other aspect. As to south <br />Canterbury Road, there azen't plans to culvert right now but he thinks it would be a <br />good idea. Almost all of the ditch is on city property with the exception of the part in <br />front of the Scheeff home. He does not believe the city would do the work in front of <br />10 <br />i <br />
