Council Minutes of 9/16/2003 <br />unanimously recommended to proceed with phase two. However, he continues to be <br />concerned about that, and he discussed the issue with the Law Director. Per the <br />ruling of the Law Director, this matter will be proceeding before City Council. He <br />will be happy to review it in the Recreation Committee if requested to do so. <br />^ Because of the city's contract with Coca Cola dating back to 1999, a question was <br />presented to the Law Director and to the city as to whether the non-recreational users <br />of the North Olmsted Park must serve Coca Cola. The answer is yes. And this goes <br />so far as to include what the individual vendors during Homecoming weekend must <br />sell to their potential customers. He believes that goes a little beyond what at least <br />City Council envisioned when the city entered into the agreement. Community <br />Council feels this presents a hardship upon them in getting vendors for the <br />Homecoming. If they are forced to serve Coke instead of Pepsi, some potential booth <br />spaces may be lost. He has requested that the Law Director provide a modification <br />from the contract that would exempt out this particular weekend, particularly given <br />the fact that it is not the city itself selling the product but rather people who have paid <br />the Community Council and who are using the park in which to provide a variety of <br />beverages to prospective customers. <br />AUDIENCE PARTICIPATION <br />Dennis Lambert, 25057 Carey Lane. <br />^ As a former Fairview Park City Council member, he noted that city was diligent in <br />the enforcement of their codes. <br />^ Wanted to congratulate the Mayor publicly for victory in winning the ethics issue <br />before the grand jury. He doesn't know anybody in the world who doesn't have a <br />special agenda or motive for doing what they do. He is a firm believer in due process <br />in America-that's what makes America great. He has been a survivor of due <br />process and would like to congratulate the Mayor on victory because it means he has <br />done what is right. He hopes the whole issue will be dropped at this point. Mayor <br />Musial responded that it had not been an ethics issue but rather a criminal issue. <br />^ Regarding the Law Dept. using public buildings, he would like the Law Director to <br />have private office in case he has to work on a private case during the day. Law <br />Director Dubelko responded that he does not do any private practice out of his <br />Community Building office. As far as he is concerned, that is city property. <br />^ Regarding the library issue, he doesn't like Resolution 2003-122. It seems like the <br />city is overstepping the line by putting tables and chairs in the library. Items to make <br />it a public building, such as carpeting, are okay. Tables and chairs are questionable. <br />But audio-visual equipment is beyond what should be done. Will the city buy the <br />books too? County taxpayers should pick this up-not the city. We pay plenty of <br />taxes for library use from property taxes and the city should not be picking up these <br />expenses. Law Director Dubelko said it was and is a cooperation agreement between <br />the county library system and the city. It states that we just don't build a library, we <br />build and furnish. We have an obligation to furnish. There have been some gray <br />areas, and this was the balance that was struck with respect to what the city would <br />furnish. Additional issues have come up that the Board of Control has wrestled with. <br />For example, on the security system, the library was told it was their responsibility if <br />i2 <br /> <br />
