Council Minutes of 9/16/2003 <br />they wanted an upgade. The city had an essential, basic obligation to furnish, and <br />audio-visual fell within that. This is all within the budget. Councilman Gareau noted <br />that Council had reduced the original list of some items by size and cost. Councilman <br />McKay has spent hours with his committee going over this list. Mr. Lambert's point <br />is well taken. <br />Daniel Gallagher, 6853 Chadbourne, is having a problem with a North Olmsted police <br />officer who, in his opinion, is harassing him. The problems date back about two years <br />ago; and, at that time, he sent a certified letter to the city issuing a complaint and <br />requesting a hearing. He does not feel anything was really done with it. He sent another <br />certified letter today, addressed to the Mayor, requesting that this be investigated. If it is <br />not investigated properly in his opinion, he plans to picket at the corner of Lorain Road <br />and Dover Center Road. Mr. Limpert said that, based on the information, he does not <br />feel Council can comment. He is sure this will be worked out between the Law Director <br />and the Safety Director. Mr. Gareau said he believed it was a matter best left to the <br />Safety Director and within the proper chain of command as opposed to presentation to <br />Council. A copy of the letter should be given to the Safety Director. Mr. Gallagher said <br />he had met with a former Safety Director and was assured that something would be at <br />least investigated. When he did receive a phone call back from the Police Dept., he felt <br />they were making assumptions before they had all the information. He felt that he was <br />not getting a fair chance. <br />Don Pangac, 23470 Sharon Drive. <br />Asked the Mayor when Lorain east of Canterbury is scheduled to be done. Mayor <br />Musial said he was hoping for 2004 or 2005. Mr. Pangrac said he had made a request <br />over a month ago to have the manhole in front of the Ameritech building on Lorain <br />Road and a manhole on Brendan Lane repaired as they are down 3 to 4 inches and are <br />a safety hazard. Service Director Driscoll came forward and thanked Mr. Pangac for <br />having brought this to his attention. He has gone out and looked at the two manholes. <br />He has asked the streets foreman to put it on the schedule to be repaired. <br />^ Mr. Pangrac asked if the city was involved with a natural gas consortium similar to <br />the electrical consortium. Mrs. Copfer answered that it was Interstate Gas, and Mr. <br />McKay said he could provide Mr. Pangrac with the telephone number. <br />^ Mr. Pangac initiated another long discussion on the water issue and asked if there <br />was any progress on water with Avon Lake. Mayor Musial said there is some <br />progress. But we have to be very careful because the way the contract is set up with <br />Cleveland, if we are not careful, we are apt to break the contract and then they can <br />charge us any rate that they want to charge. So, we are moving very slowly on that. <br />Mr. Gareau said that City Council stepped up to the plate and did the very best they <br />could on the water rates issue. They enacted a resolution directing the Mayor to <br />undertake a study of water rates, usage, disconnecting and reconnecting. The Mayor <br />questioned whether or not it was within Council's authority to do that. There has now <br />been a ruling by the Law Director that it was not. This was Council's attempt to try <br />to get the issue going-they did the hest they could and it was found to be over- <br />reaching on their part. It now lands back on the administrative side of the aisle as to <br />whether or not anything gets done on the issue of studying water rates.
