Council Minutes of 8/5/03 <br />Dennis Lambert, 25057 Carey Lane, said this Charter amendment issue is one he raised a <br />number of years ago. He believes there is some political polarization between Council <br />and the administration. But he does commend the sponsors of the legislation for taking <br />the initiative to legislate and bring forth what is something that is in practice, not only at <br />this level in many municipalities, but on the state and national level. It is a check and <br />balance-the right for the legislative body to review and give consent or dissent against <br />the administration's appointment to a position. He believes it will work well in this <br />community. It means check and balance, and it means good government. <br />Cindy McCrinty, 24212 Elm Road and Jennifer Jonas, 24238 Elm Road, came forward to <br />discuss various problems with their neighbor. They have contacted numerous people in <br />the city government, but have not had any help. Mrs. McGinty said the city issued a <br />permit for her neighbor to put up a fence. She had a survey done and it was determined <br />the fence is on her property, but the neighbor refuses to remove it. These neighbors have <br />threatened her and other people. The neighbor has placed cameras outside their home. <br />The problem is continually getting worse as the neighbor lady does not drive carefully <br />and has almost hit people when she is backing out of her driveway. The police have been <br />called a number of times. She is fiustrated and wants to know what can be done. <br />Councilman Nashar suggested that Mrs. McGinty call the Community Policing office to <br />mediate. Mrs. McCrinty said she had done so. Law Director Dubelko said he had talked <br />to Mrs. McGinty some time ago and explained there is no legislation prohibiting the <br />video cameras. He knows the police have been out there a number of times. The last he <br />heard, the City Prosecutor told him the situation had been resolved to the neighbors' <br />satisfaction. Mrs. McCrinty indicated it had not been resolved to her satisfaction. In <br />addition to these matters, there is a problem with water drainage. Safety Director Jesse <br />said he is fully familiar with this situation. There are various issues involving the <br />Building Department, Engineering Department and Police Department. There is a <br />combination of major civil matters between the two parties and also some casT3'-over with <br />some criminal allegations. Police have looked into this and mediation was discussed and <br />brought as an alternative a while back, and there was only participation from one of the <br />parties. Community policing has been involved-it is an on-going situation. They are <br />trying to do whatever they can within the confines of the ordinances to make a positive <br />resolution. It is going to take some time as there are major differences between the two <br />residents. It won't be resolved tonight. He invited Mrs. McGinty to meet with him and <br />the other departments heads. It will take everybody's effort to resolve the problems. <br />Councilman Gareau suggested to Mrs. McGinty that she seek private legal assistance as <br />there may be remedies at law for the encroachmentftrespass issue. Mrs. McGinty said <br />she had done so and had been advised to notify Council of the problems. President <br />O'Grady advised Mrs. McGinty that Council has heard her frustrations, and she should <br />meet with the Safety Director and continue to call the police if necessary. She was <br />invited to notify Council if the problem is not resolved. <br />Patricia Deis, 26893 Sweetbrier, expressed surprise that the Mayor would say that there <br />were no adverse comments or complaints about service due to his appointment of Mary <br />Creadon to Service Director. Perhaps the Mayor is suffering from a syndrome called <br />"ostrich." <br />13 <br />
