Council Minutes of May 20, 2003 <br />are basically on schedule and had lost only a few days to rain. As to weekend work, he <br />would rather not spend money for overtime as the project seems to be moving along. <br />Law Director Dubelko: 1) With regard to the library contracts, they do have appended to <br />them a time schedule which attempts to indicate expected dates that each different trade <br />will be going forwazd. An effort was made to craft the contracts so there would be <br />coordination between the trades and penalties for being late. So there aze some <br />provisions in the contract. If Council has specific questions regazding a contract, he <br />would be happy to discuss it. <br />2) One of the important jobs in his office is to prepaze and review contracts involving the <br />city. There were four contracts prepazed and reviewed since the last Council meeting: <br />the Lorain Road rehabilitation project; the pavement markings contract; the Northern <br />Avenue water main relocation contract; the slab repair contract. In the contracting <br />process, once competitive bidding has been completed and the Boazd of Control awazds a <br />contract, the department involved will send a draft of a form contract to the Law Dept. It <br />is reviewed along with the variable information, changes are made, and it is sent back to <br />the department. A finalized contract comes back to the Law Department, he signs off on <br />it, it goes to Finance for determination of availability of funds, and then it is sent on to the <br />Mayor's office for execution by the Mayor on behalf of the city and then by the <br />contractor. <br />3) On May 9, he attended a municipal law seminar sponsored by the Ohio Municipal <br />Attorney's Association. Some of the issues discussed were the new state right-of--way <br />laws and the status of several actions filed by cities who had passed right-of--way law; <br />Phase II storm water regulations; public records law; tort reform and sovereign immunity <br />issues; legislative updates; business improvement districts; home rule issues; regulatory <br />takings. If Council members have questions in any of these azeas, please feel free to <br />contact him. <br />4) On May 12 and May 20, directors' meetings were held. Each of those meetings, just <br />as the meetings discussed last month, were very beneficial. He continues to believe City <br />Hall works best when everyone works in a team fashion. <br />5) On May 12, a Board of Control meeting was held. <br />6) On May 14, the city's NOMBL negotiating team met. The NOMBL collective <br />bazgaining agreement ends on July 31, so the team is preparing for negotiations. <br />7) He attended, along with President O'Crrady and a member of the Personnel <br />Department, an ethics law workshop sponsored by the City of Olmsted Falls. The speaker <br />was a representative from the Ohio Ethics Commission. It was a very good nuts-and- <br />bolts-type presentation. If members of Council have questions regarding ethical issues, <br />like gifts and public contracts, please contact the Law Department for advice. <br />8) On May 20, the city was served with a lawsuit filed against it in federal district court <br />by former Assistant City Engineer David McDermott. He has brought an age <br />discrimination complaint against the city. It is the city's obligation to turn it over to our <br />insurer for defense. Preliminarily, it appears that we have coverage in the matter. <br />9) He is continuing to work on the analysis of comp time throughout the different <br />departments and hopes to provide it to Council soon. <br />~, <br />4 <br />
