Council Minutes of May 20, 2003 <br />Councilman Miller gave an abbreviated report on behalf of Councilwoman Kasler, <br />chairperson of the Public Safety, Health and Welfare Committee: 1) On Wednesday, <br />May 14, the Safety Committee met and all members were present. The following items <br />were discussed: <br />Ordinances 2002-85 and 2002-88. The committee recommended these ordinances be <br />tabled, and they are on the agenda to be tabled this evening. <br />Ordinance 2002-86, which Mr. Nashar will be amending this evening. The <br />committee recommended approval as amended as well as for Ordinance 2002-87. <br />A liquor permit for Chipotle Crrill. The Chipotle organization has applied for a DS <br />liquor license for alcoholic beverages to be consumed on premises. As the Police <br />Dept. had no objection, the committee recommended that Council vote not to object <br />to the issuance of the liquor license to Chipotle Grill. Councilman Miller moved that <br />Council have no objection to the DS liquor permit for Chipotle Grill. The motion was <br />seconded by Councilman Nashar and passed unanimously. <br />Councilman Miller, chairperson of the Intra-Governmental Relations and Legislation; <br />Long-Range Planning Committee: 1) The Legislative Committee met on Wednesday, <br />May 14, to discuss Ordinance 2003-43. The committee discussed various issues <br />presented by the Mayor and the Safety Director. The Mayor submitted his report in the <br />form of a letter. Issues discussed included whether or not a person who is an employee <br />would be entitled to payment for witnesses that are called, whether there is a mechanism <br />procedure for City Council intending to create an evidentiary record, the evidentiary <br />record would be the same as now used, which is the tape recorder. Also discussed were <br />issues such as contempt and how one can appeal and the appellate process. The final <br />issue discussed was a result of the Mayor's comments/questions as to where this was <br />going and whether it involved any particular issue. All committee members indicated <br />that they did not intend to use Ordinance 2003-43 for any events that have happened in <br />the past as it applies to Council and any directors. The legislation is not intended for that <br />purpose and will not be used for that purpose. (Ordinance 2003-43 will be amended by <br />Mr. Gareau during the Legislative portion of the meeting.) <br />AUDIENCE PARTICIPATION <br />John Davis, 5862 Barton Road, gave a chronological list of dates beginning with <br />February 19, 2002 when he first inquired about sidewalks for Bradley Road as it was a <br />safety issue for children. He had been assured that the Metroparks planned to continue <br />their sidewalk bike path up to the gun club which would meet with the city's portion of <br />the sidewalk. The sidewalks are not yet in, but both sides of Bradley Road were staked <br />for sidewalks several weeks ago. He would like to know the completion date for the <br />sidewalks. Mayor Musial answered that he did contact the Metroparks, but they will not <br />put in their share of the sidewalk extending the current sidewalk/bike path to the North <br />Olmsted city line until the city completes its part of the bargain by putting in the <br />sidewalk. In terms of a precise date, he cannot give that but it will be done this year. <br />City Engineer Durbin said Service employees had done the staking, but he is not aware <br />of the precise date for completion.
