Council Minutes of 5/7/2003 <br />2) The Finance Committee met on Wednesday, May 7. In attendance were committee <br />members Kasler, Limpert and McKay; Councilpersons Gareau, Nashar, Dailey, Miller; <br />Council President O'Grady; Mayor Musial, Finance Director Copfer, Law Director <br />Dubelko, Safety Director Jesse, Personnel Director Farver. The following items were <br />discussed: <br />^ Ordinance 2003-50. This ordinance eliminates comp time for overtime and overtime <br />compensation for directors. The committee recommended approval and passage under <br />suspension of the rules. <br />^ Ordinance 2003-71. This ordinance will transfer the $8,000 to outside operations to <br />pay for the services provided by R. E. Warner. It will also transfer $10,000 to cover <br />the inspector to return from layoff. The committee recommended approval and <br />suspension of the rules. <br />Councilman Nashar, chairperson of the Building, Zoning and Development Committee: <br />1) The Building, Zoning and Development Committee met on April 29. Present were <br />committee members McKay, Gareau, Nashar; Councilmen Miller, Limpert and Dailey; <br />President of Council O'Grady; City Forester Wendell, Assistant Building Commissioner <br />Rymarczyk, Law Director Dubelko. Agenda items were as follows: <br />Ordinance 2003-69, an ordinance amending Section 950.03 of Chapter 950 of the <br />Streets, Utilities and Public Services Code entitled "Urban Forest" by inserting <br />standards and procedures for tree preservation and/or removal permits in the course of <br />development plan review and to authorize the assessment of permit fees for the <br />Forester's review and declaring an emergency. Ordinance 2003-69 is designed to <br />protect the existing trees and the vegetation of commercial and residential multi- <br />family homes. A companion ordinance, Ordinance 2003-70, was also discussed. This <br />legislation amends Section 950.02 of Chapter 950 of the Streets, Utilities and Public <br />Services Code entitled "Urban Forest" to revise certain duties of the City Forester and <br />declaring an emergency. This gives the City Forester the vested duties and powers to <br />enforce this ordinance, and he will make the decisions as to what trees will be <br />removed and which ones will remain. The legislation provides for the assessment of <br />fees. After lengthy discussion with the City Forester and the Law Director, the <br />committee unanimously recommended approval of Ordinance 2003-69 and Ordinance <br />2003-70 as amended. <br />T-Mobile Wireless Communications. Representing T-Mobile was John Sindyla. This <br />is a proposal for a wireless communication tower to be located on the northwest <br />corner of Brookpark Road and Clague, adjacent to I-480. The proposal consists of a <br />160 foot tower to be installed within the Ohio Department of Transportation right-of- <br />way. The area will be 60 x 60 square feet. This will be an enclosed area with a 7 foot <br />high fence around it. The city preferred to relocate the tower further north on the <br />property, but ODOT would not agree. The BZD Committee did ask to improve the <br />landscaping near the fenced area by adding additional trees, with the <br />recommendation/approval of the City Forester. Councilman Nashar moved that <br />Council approve the proposal for T-Mobile Wireless Communications subject to the <br />recommendations of the various boards and commissions and the City Forester.
