Council Minutes of 3/4/2003 <br />Councilman Nashaz, chairperson of the Building, Zoning and Development Committee: <br />1) The BZD Committee met on February 25. Present were committee members McKay, <br />Gareau and Nashaz; all of Council and President of Council O'Grady; directors Conway, <br />Dubelko and Jesse. The committee discussed Ordinance 2003-36, an ordinance <br />amending Section 1123.13 of the North Olmsted Zoning Code entitled "Finality of the <br />Board's Order" to permit the city to seek appellate review of determinations made by the <br />Board of Zoning Appeals. This will permit the city to appeal a decision rendered by the <br />city's Board of Zoning Appeals to the Court of Common Pleas for Cuyahoga County if it <br />does become necessary. The committee recommended approval and made a <br />recommendation to forward this on to the Planning Commission for their review. <br />Councilman Nashaz moved to refer Ordinance 2003-36 to the Planning Commission. The <br />motion was seconded by Councilman McKay and passed unanimously. <br />2) Mr. Nashaz congratulated Councilman McKay as he and Mrs. McKay are celebrating <br />their SOa' wedding anniversary. Mr. & Mrs. McKay were congratulated by all. <br />Councilman Limpert, chairperson of the Streets & Drainage Committee, noted that <br />capital improvements would be discussed tomorrow. Because of the weather, it hasn't <br />been possible to do an organized tow of the streets. If Council members have an <br />opportunity to personally drive through areas that have been discussed, it might be <br />advantageous. Councilman Miller asked whether or not the slab repair and street repair <br />decisions have already been made in light of the fact that the Mayor has said he was <br />going to present Council with a list of streets along with the legislation. Councilman <br />Limpert said not that he was aware. In fact, he was a little surprised because in past years <br />this type of legislation (Ordinance 2003-37) did not name streets. To his knowledge, a <br />decision has not already been made. <br />Councilwoman Kasler, chairperson of the Public Safety, Health & Welfare Committee: <br />1) The Safety Committee met on Tuesday, February 25. Present were committee <br />members, other Council members, the Mayor and directors. The committee discussed a <br />new liquor permit for the North Olmsted Marathon gas station located at 28800 Lorain <br />Road. This is a C1 and C2 permit which allows the sale of beer in its original container <br />only and the sale of wine and certain pre-packaged mixed drinks in sealed containers for <br />carry-out only. Absent any objections from the Police Dept., the committee voted to <br />abstain from any objection to this permit. Councilwoman Kasler moved that Council <br />have no objection to the new liquor permit for the Marathon gas station at 28800 Lorain <br />Road, and the motion was seconded by Councilman Nashar. Roll call: Kasler, yes; <br />Nashar, yes; Dailey, yes; Limpert, yes; McKay, no; Miller, no, commenting that, given <br />all the other locations that there are in the city to purchase such alcohol, he doesn't think <br />we need to be selling it from our gas stations. The motion passed with four yeas and two <br />nays. <br />2) On a safety related issue, she was recently contacted, as chairman of the Safety <br />Committee, by a Plain Dealer reporter who informed her that our city was rated by a <br />bicycle activist organization as poor due to our traffic code which limits the ability to ride <br />bicycles in the street. Basically, it's the belief of this group, which is headed by a very <br />knowledgeable and educated person in this area, Mr. Oswald, that riding in the street as <br />opposed to sidewalks is actually for various and specific reasons more safe.
