MINUTES OF THE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />FEBRUARY 18, 2003 <br />Present: Council President O'Grady, Council Members Dailey, Gareau, Kasler, <br />Limpert, McKay, Miller, Nashar <br />Also Present: Law Director Dubelko, Finance Director Copfer, Clerk of Council Seman <br />President of Council O'Grady called the meeting to order at 8 p.m. in Council Chambers, <br />5200 Dover Center Road, North Olmsted, Ohio. <br />Members of the audience were invited to join Council in reciting the Pledge of <br />Allegiance to the Flag. <br />The minutes of the Council meeting of December 17, 2002 were approved as written. <br />The minutes of the Council meeting of January 7, 2003 were approved as written. <br />President O'Grady announced that the following legislation would be passed under <br />suspension of the rules: Resolutions 2003-15, 2003-35. <br />President O'Grady announced that Mayor Musial was ill and would not be in attendance. <br />RE_ <br />Law Director Dubelko: 1) On February 6, he met with the Safety Director and others <br />regarding a request by the mayoral recall group to use the multi-purpose room at the <br />Recreation Center for a political meeting. It was reviewed, and he did provide legal <br />advice to the city administration that the city was not required by the Constitution to open <br />up that room for political meetings. The history that was provided to him indicated that it <br />had never been previously used for meetings that were not recreation oriented. <br />Therefore, that was the advice that was provided to the administration. In addition, there <br />was supplemental advice regarding the rights of citizens to engage in protected activities <br />under the First Amendment in the Recreation Center subject to narrowly drawn <br />regulations by the city in that regard. <br />2) On February 7, he provided advice to the Building Commissioner regarding employees <br />having part-time employment outside the city. <br />3) On February 10, he reviewed and provided advice to the Engineering Dept. regarding <br />the proposed EPA Phase II plan for the city regarding storm water management. <br />4) On February 11, the Board of Control met and awarded contracts for all of the library <br />construction contracts except bid package No. 3., which is the concrete work. There is a <br />disqualification hearing set for tomorrow regarding the apparent tow bidder on that bid <br />package No. 3. It turns out that the contracts were awarded so that the original contract <br /> <br />
