Hopefully, funds will be available in <br />the next couple of years to complete the improvement of the road. <br />Joseph Bouman, 23950 Gessner Road, North Olmsted, is concerned about NOMBL and <br />asked whether RTA is trying to close it down and if the citizens can do anything about <br />this situation. Law Director Dubelko said the city is currently in negotiations for renewal <br />of the operating agreement. He has reported to Council that the negotiations have been <br />difficult. While it is counter-productive to fully discuss the negotiations in public, he has <br />publicly said there are certain goals that the city wants to achieve in these renewal <br />agreement negotiations which have occurred every five years since 1975. We want to <br />make sure that we do our part to maintain good bus service in the western suburbs. We <br />want to make sure that we protect the rights of our employees who, if there was <br />discussion of a merger, have a lot of protections both under the current operating <br />agreement and also under state law. We want to make sure we protect the City of North <br />Olmsted because we have a great investment in that bus line and we want to protect it. <br />The operating agreement has always contained a provision which contemplated that there <br />may come a day when RTA would take over our bus line. The agreement can be <br />terminated with a six month notice. The buses, with the exception of two antique buses, <br />are owned by RTA. There are certain pieces of equipment in the garage that are owned <br />by the city and some are owned by RTA. The current agreement has an expiration date <br />of December 31, 2004, which is less than six weeks away. We are going to continue to <br />negotiate up to that deadline, and there is a good chance of an extension of the agreement <br />to get us past December 31 to a time when the negotiations can be concluded. Mr. <br />Bouman can contact the Law Department for a copy of the current operating agreement <br />which is a public record. <br />LEGISLATION <br />Ordinance No. 2004-157 introduced by Councilman Nashar on behalf of Mayor Musial <br />was given its third reading. An ordinance enacted by the City of North Olmsted, <br />Cuyahoga County, Ohio, hereinafter referred to as the MUNICIPALITY, authorizing a <br />cooperation agreement between the MUNICIPALITY and the COUNTY in the matter of <br />the hereinafter described improvement (Clague Road (CR-52) from Interstate I-480 to <br />Lorain Road), and declaring an emergency. Councilman McKay moved for adoption. <br />The motion was seconded by Councilman Dailey and passed unanimously. Ordinance <br />No. 2004-157 adopted. <br />Resolution No. 2004-160 introduced by Councilman McKay on behalf of Mayor Musial <br />and the entire City Council was given its third reading. A resolution authorizing the <br />Mayor to enter into a contract with the Cuyahoga County General Health District for the <br />year 2005, and declaring an emergency. Councilman McKay moved for adoption. The <br />motion was seconded by Councilman Gareau and passed unanimously. Resolution No. <br />2004-160 adopted. <br /> <br />12 <br />
