Council Minutes of 11/3/2004 <br />^ November 3, the city filed a complaint in Rocky River Municipal Court to recover <br />~~,~ approximately twelve thousand dollars in damages caused to two police vehicles <br />several months ago on McKenzie Road by an intoxicated motorist. <br />2) Collective bargaining update: all of the language issues in the remaining contracts that <br />have not been approved by Council have been resolved. The fire fighters contract, <br />Resolution No. 2004-131, is before Council this evening for approval and authorization. <br />The remaining two contracts, ClericaUTech and Dispatch, will be presented at the next <br />regular Council meeting. <br />3) October 21, attended a meeting with directors Copeland and Wenger and Kiwanis <br />representatives to discuss the Special Children First property on Butternut Ridge Road. <br />4) October 21, issued formal Legal Opinion 2004-OS regarding the authority of the Chief <br />of Police to control which city officials and employees should have access to confidential <br />law enforcement data bases. <br />5) October 25, attended another meeting with RTA and NOMBL representatives along <br />with the Service and Finance Directors for the renewal of the operating agreement. As <br />reported to Council previously, these negotiations are extremely challenging this year, <br />primarily because of RTA's difficult financial condition. We are proceeding slowly and <br />cautiously. Negotiations will probably not be completed in time to present an agreement <br />to Council this month. It is possible that he will bring legislation to Council at the next <br />meeting which would authorize a temporary extension of the operating agreement while <br />negotiations for a permanent extension continue into 2005. When the negotiating team <br />is closer to having a better feel for the direction these negotiations are headed, he will <br />provide Council in writing with a more detailed status report. <br />6) October 22 through 25, reviewed and negotiated changes in the MUMS contract for <br />the new financial accounting system. An agreement was reached on all the recommended <br />changes from the Law Dept., and the revised agreement has been submitted back to <br />Finance. It has been executed by all parties and is ready for implementation. <br />7) October 26, attended a directors' meeting at City Hall. <br />8) October 27 through 29, conducted legal research and provided written legal advice to <br />the Director of Finance in the form of Legal Opinion 2004-06 regarding a public record <br />request for certain financial records in "machine readable ASCII text format." He has <br />requested that the opinion be posted on the city's website. <br />9) October 28, met with Dave Boatman, president of Local 1267 of the IAFF, to resolve <br />the few remaining language differences in the new collective bargaining agreement, <br />which is before Council for approval tonight. <br />10) October 29 through November 1, made substantial revisions to and legally approved <br />the proposed Sports Venue Advertising contract, which is before Council tonight as an <br />attachment to Resolution 2004-167. <br />11) November 1, reviewed, revised and legally approved a proposed administration <br />policy regarding Internet and a-mail usage by city employees. <br />12) November 2, prepared a memo containing legal advice and recommended actions for <br />the administration and the Council Cable Advisory Board regarding an anticipated sale of <br />assets of Adelphia Communications Corporation and a probable transfer of the franchise <br />agreement in early 2005. <br /> <br />3 <br />,r~Y~~~,<.. , <br />
