"~ MINUTES OF THE MEETING OF THE COUNCIL <br />~' OF THE CITY OF NORTH OLMSTED <br />SEPTEMBER 21, 20(14 <br />Present: President of Council O'Grady, Council Members Dailey, Gareau, Kasler, <br />Limpert, McKay, Miller, Nashar <br />Also Present: Law Director Dubelko, Finance Director Copfer, Clerk of Council Seman <br />President O'Grady called the meeting to order at 8:05 p.m. in Council Chambers, 5200 <br />Dover Center Road, North Olmsted, Ohio. <br />Members of the audience were invited to join Council in the recitation of the Pledge of <br />Allegiance. <br />Councilman Miller made a motion to remove Resolution No. 2004-128 from the agenda. <br />The motion was seconded by Councilman Nashar and passed unanimously. <br />The minutes of the Council meeting of September 7, 2004 were approved as written. <br />President O'Grady announced the following legislation would be considered for passage <br />under suspension of the rules: second reading, Ordinance 2004-137; first reading, <br />Resolutions 2004-147 and 2004-154. <br />REP RTS <br />Law Director Dubelko: 1) Litigation update: On September 8, we received an order <br />from the Court of Appeals in the State ex rel. Musial vs. City of North Olmsted case <br />directing the respondent city officials to inform the court by affidavit by September 23 <br />"whether the Auditor of the State of Ohio conducted an audit of the Springvale facility <br />and identify what documents, if any, were provided to the State Auditor to assist with the <br />audit." He has provided information to attorney Fred Whatley of Walter & Haverfield <br />who is defending the city to assist in the preparation of that affidavit. On September 9, <br />there was an order issued in the Berg vs. City of North Olmsted case extending the dates <br />of the brief schedule which is now due on September 24. On September 17, Assistant <br />Law Director O'Malley attended the case management conference held in the case of Bak <br />vs. City of North Olmsted. Judge Ambrose set deadlines at that case management <br />conference for discovery and for the filing of dispositive motions and also set a trial date. <br />2) Collective bargaining update. Following Council's approval of the Service unit's <br />collective bargaining agreement on September 7, he forwarded notice to the city and the <br />union reps of the fact of Council's approval and requested that a date be set for execution <br />of the new agreement. The matter is still pending. On September 8, he received a written <br />communication from the OPBA representing the city's dispatchers advising that its <br />representatives will not be able to sit down with city employee represematives until the <br />
