Council Minutes of 9/21/2004 <br />Building Commissioner, the Assistant City Engineer and the Law Director also had an <br />opinion that this seemed to be going in the right direction. The Planning Commission <br />also recommended this change. The committee recommended approval of the legislation <br />by a vote of 2 to 1. <br />2) The Building, Zoning & Development Committee met on Tuesday, September 14, <br />2004. Committee members were present with the exception of Mr. McKay. Legislation <br />that was discussed included the following: <br />Ordinance 2004-119, an ordinance amending Section 1345.01 and 1345.02 of the <br />Building Code to exclude landscaping features from permit and fencing requirements <br />in Section 1345.01 and 1345.02 and declazing an emergency as amended. The <br />legislation was amended in committee. This ordinance deals with our current code <br />which requires, when individuals wish to install an aquatic land feature in their <br />backyazd (perhaps a small pond), that a permit be applied for and a 6 foot high fence <br />be installed to surround that aquatic feature. Thus taking away some of the aesthetic <br />quality of putting a pond in a backyazd by surrounding it with a 6 foot high fence. <br />Most of the applicants that were applying for permits were requesting to appear <br />before the Board of Building Code Appeals. Not surprisingly, their appeals were <br />being granted. Because this had been going on for some time, it was decided to <br />simply change the code to accommodate these types of aquatic features in people's <br />yazds, with some exceptions. The legislation was amended to not require a permit or <br />a fence if the aquatic feature does not exceed 18 inches in depth and does not excced <br />50 squaze feet. When first brought forward, there was no good or clear definition of <br />where the line would be drawn between an aquatic feature versus somebody's <br />backyazd pond. So the additional language drafted by the Building Dept. and the Law <br />Dept. was to limit that at 50 squaze feet in area and 18 inches in depth. The <br />committee unanimously approved the legislation with the amendments. Councilman <br />Gateau made a motion to amend Ordinance 2004-119 consistent with the <br />amendments as reported and written in the legislation. The motion was seconded by <br />Councilman McKay and passed unanimously. Ordinance No. 2004-119 amended <br />Councilman Gateau announced that Planning Director Wenger would hold a public <br />forum at 7 p.m. on Thursday, September 30, to discuss the city's master plan. She has <br />been in chazge of a steering committee that has been working since January to put <br />together a plan concerning land use and development, economic development, housing, <br />infrastructure and public facilities, open space and recreation and community chazacter. <br />She has worked very hazd on that along with the steering committee. <br />AUDIENCE PARTICIPATION <br />Charles Dial, 27959 Gardenia Drive <br />^ Asked about the progress of the replacement of the WWTP transformer. Service <br />Director Driscoll answered that a quote had been received from the Illuminating <br />Company, and it does seem very reasonable.
