Council Minutes of x/3/2004 <br />.,,~, 2) He attended the Eagle Court of Honor for Eagle Scout Kevin Kurtz who was <br />recognized at a Council meeting in June. <br />3) During the month of August, he took atwo-week vacation, which was the first time in <br />over six yeazs that he has taken any extended leave. He returned refreshed and with a <br />decision to re-evaluate his role as Mayor. He will emphasize what he does best-getting <br />out into the community, having lunch with the shakers and movers in the City of North <br />Olmsted to make sure that they are happy, to make sure that we aze doing as a city what <br />we can do to keep them here as a thriving organization and otherwise grease the rails <br />between the business community and the City of North Olmsted. As a start, this Friday <br />he will have lunch with Mike McIntosh, the coordinator of the Westfield Ma11, to discuss <br />various aspects involving the mall expansion. <br />4) The annual Fourth of July bike parade, resident picnic and children's games in the park <br />were held on Monday, July 5, and enjoyed by all. Rec Commissioner Ted DiSalvo and <br />his staff did an excellent job of coordinating and conducting the activities. <br />5) Regazding the issue of placing the proposed fire station #2 on the ballot in November, <br />two resolutions must be passed by City Council. The first, Resolution 2004-107, <br />provides for the securing of the millage to be applied to the bond issue in November. If <br />the resolution is passed this evening, the millage will be certified by the Cuyahoga <br />County Auditor. Once that is complete, the second resolution to proceed with the <br />submission of the issue to the voters will be introduced. He believes the millage will be <br />approximately .35 mills, which works out to about $16 a yeaz per $150,000 home. <br />6) He is continuing with the "big four" meetings to make sure that the people who aze the <br />movers and shakers in the city and the city government aze all moving forwazd in the <br />same direction. He will be meeting with labor representative John Ryan, executive <br />secretary of the AFL-CIO; Dr. Kurt Stank, superintendent of the North Olmsted City <br />Schools; Greg Birney, newly appointed executive director of the Chamber of Commerce; <br />and one of the co-presidents of the Chamber of Commerce. <br />Law Director Dubelko: 1) Litigation updates: In the case of Bak versus the City of <br />North Olmsted, our insurance company has denied coverage because this dispute <br />involves a contract matter arising out of a city employment. The matter will be handled <br />in-house by the Law Dept. On July 2, he filed a first leave to plead in the case with <br />Cuyahoga County Common Pleas Court. On July 13, he filed a joint answer on behalf of <br />the city and the Mayor. The lawsuit will be vigorously defended as the city does not <br />believe there is any substance to it. In the case of OBrien versus the City of North <br />Olmsted, insurance defense counsel is on board on that case, which involved an accident <br />with a NOCOP van. On July 16, an answer was filed on behalf of the city. Assistant <br />Law Director O'Malley is monitoring the work of the insurance defense counsel. In the <br />case of Berg versus the City of North Olmsted, which is a 2506 appeal involving the <br />proposed car wash at the corner of Clague and Brook Pazk, a case management <br />conference was held on July 1, 2004. Assistant Law Director OZVlalley appeared on <br />behalf of the city. At the case management conference, a briefing schedule was <br />established for the appeal. On the pending public records case, there were a number of <br />filings in the months of June and July, approximately a total of 14, which related to the <br />indexing order that the court had issued.
