Council Minutes of 8/3/2004 <br />members Kasler, Miller and Limpert; Councilpersons McKay, Nashar and Dailey; Mayor <br />Musial, Law Director Dubelko and Safety Director Jesse. The committee discussed <br />Ordinance 2004-106, an ordinance creating a new Section 109.07 of the Administrative <br />Code of Chapter 109 entitled "Public Meetings" in order to clarify the clerical <br />responsibilities for open public meetings and keeping the public functions and records of <br />the various boards and commissions of the City of North Olmsted and declaring an <br />emergency. He asked for input from various clerks, and they seemed to be clear on what <br />this means and do not have any particular problems with it. This will not require them to <br />attend all meetings and to prepare verbatim meetings of those meetings. Some of the <br />boards akeady have appointed members who act as secretary for that board or <br />commission who will keep notes for the minutes of those meetings. The various clerks <br />may be asked to prepare agendas, type those various secretarial notes and maintain the <br />public records. There is some question as to the responsibilities for the Housing Council <br />and the Tax Incentive Review Council. The Law Director has recommended that those <br />questions be addressed in a separate ordinance. The committee unanimously <br />recommended approval. <br />Councilman Miller, chairperson of the Public Safety, Health & Welfare Committee: 1) <br />The Safety Committee met on June 22 to discuss an issue of cell phone use in <br />automobiles and the current ordinance that applies. It was agreed upon that the <br />committee would do a little bit of research before going forward with this issue. He has <br />received some input from two local police departments and from the state legislature and <br />that will be discussed in committee. <br />2) The committee met on August 2 to discuss a liquor license permit request for Buckeye <br />Barbecue, DBA Famous Dave's, to be located at 26410 Great Northern Plaza, in the <br />building formerly occupied by Chi Chi's. This permit was also discussed this evening. <br />The Police Department had no objection to the permit. It is a DSI license, spirituous <br />liquor for on-premise consumption only and beer and wine for on-premises and off- <br />premises in original sealed containers unti12:30 a.m. The committee recommended that <br />Council not object to this liquor permit. Councilman Miller moved that Council have no <br />objection to the DSI liquor permit for Buckeye BBQ, DBA Famous Dave's. The motion <br />was seconded by Councilman Gareau and passed unanimously. <br />3) The committee also discussed at length Ordinance 2004-107, which is the ordinance <br />relating to the Fire Station, and is the first of two required pieces of legislation. The <br />legislation had been previously discussed in committee and it was reported out that it was <br />recommended for approval. However because some questions did come up after that, he <br />felt it appropriate that Council have the opportunity to ask all their questions. The <br />answers to the questions were quite enlightening. Some comparisons were made to other <br />cities as to why we would need a new station of this size. The cities of Strongsville and <br />Westlake were discussed as was Olmsted Falls which has a new station opening this <br />week. The size and shape of our city was sited as the explanation for the size of the fire <br />station. For example, Strongsville can go to smaller size stations because they need to <br />have more stations in order to be timely in their response to emergencies. Because of the <br />shape and size of our city, we need to be spread out a little bit more and we need to go <br />with a larger size. Other reasons for the size of this building include, but are not limited <br />to, a need for better living space for the staff and a better foundation. The foundation of <br />5 <br />i <br />
