Special Council Minutes of 6/28/2004 <br />landscaped areas. The trees, as noted on the map, will be preserved in consultation with <br />the Director of Planning and the City Forester, in consultation additionally with residents <br />to the extent possible on any azea to the outside of the mound. A release will be obtained <br />from Mr. Biskind, to the satisfaction of the Law Department, with respect to his claim for <br />any damages that he may or may not have as to the development of the proposal. That <br />the development will not be done in phases. A great deal of discussion azose with respect <br />to who will maintain and what will take place in the ?5 foot setback area which is on the <br />outside closest to the residential properties. After a great deal of discussion on that <br />particular topic, it was agreed that the area is going to be excavated. It is going to be <br />covered in that setback area and it would be in the best imerests of all involved that the <br />setback area. will be landscaped in conformity and discussion with the Architectural <br />Review Board. From ARB we can get some sort of a guide as to what type of growth we <br />can put in that will be allowed to maintain itself and grow in a natural condition. <br />Councilman Gareau made a motion that Council approve the Parcel E site plan with all of <br />the recommendations as stated above and of the various boards and commissions. The <br />motion was seconded by Councilman McKay. Roll call: Gareau, yes; McKay, yes; <br />Nashar, yes, with brief comment. After fourteen years or longer, he is pleased to see that <br />this parcel of land will be developed with the blessing of the residents who had a major <br />input with their ideas and in the process. This will be another major improvement to the <br />City of North Olmsted. Roll call continued:. Dailey, yes, with comment. Much has been <br />promised on this development, and he expects the developer to meet and exceed what is <br />expected from here on out. He expects the developer to set the example of how to treat <br />the residential neighbors and not to need encouragement from the city or this body. He <br />enthusiastically votes yes on this project. Roll call continued: Kasler, yes; Limpert, yes; <br />Miller, yes, with comment. He would like to thank the residents who paid so much <br />attention to this issue and were diligent in attending meetings, organizing meetings and <br />Ward Councilman McKay who was there at every meeting; and hopefully this will turn <br />out to be one of the best projects to this city in a long time. The motion passed <br />unanimously. <br />Councilman Gareau made a point of clarification in his report. When he spoke of the 75 <br />foot setback area, he did not mean to limit it to those areas where there is actually a 75 <br />foot setback. Along Linda Drive, it's a smaller area. Anything he said with respect to <br />conditions and requirements upon a 75 foot setback applies equally to the area along <br />Linda Drive, to the south of those properties as well. Also, as a part of his report, he is <br />including some documents: The Overall Site Plan with Existing Trees which was <br />received on June 22, 2004 is included as a reference guide for the Director of Planning <br />and City Forester to determine which trees would be marked and preserved. A materials <br />list is included. <br />Councilman Miller, chairperson of the Public Safety, Health & Welfare Committee: 1) <br />On June 22, the Public Safety Committee met to discuss Resolution 2004-107, a <br />resolution determining to submit to the electors the question of issuing bonds for the <br />purpose of constructing, furnishing, equipping and otherwise improving a fire station, <br />providing fire apparatus and equipment to be housed therein and acquiring, preparing and <br />9 <br />,., .
