Council Minutes of 6/15/2004 <br />be located on the city property or the library property, and then who would in turn be <br />responsible for maintenance of the fence. If it is being built on library property as <br />part of the project, the library would assume responsibility for that fence. The <br />committee, upon the recommendation of the Planning Director and discussion with <br />the Service Director, indicated that the fencing should be forwarded to the Planning <br />Commission for their input since we have not received any Planning Commission <br />approval of this particular part of the project. The matter remains in committee at <br />this time. <br />• Ordinance 2004-103, an ordinance amending Section 149.02 of Chapter 149 of the <br />Administrative Code of the City of North Olmsted entitled "Planning Commission" <br />so as to expand notification of residents and property owners for review of <br />development plans which also include rezoning proposals. This ordinance expands <br />the notice for site plans and development plans when a development plan is <br />accompanied with a request to rezone. The notice of development site plans currently <br />is listed for contiguous property owners. The notice for rezoning issues is 1,000 feet. <br />This creates a disjointed notice provision, whereby some people who are <br />immediately adjacent may receive notice of the project. If there is a rezoning <br />proposal, the notice becomes wider and more people become interested, <br />unfortunately later in the process. This proposed change would provide that all <br />property owners within 1,000 feet would receive notice of not only the development <br />plan itself but also the rezoning as they originally would have received it. The most <br />recent situation where this came up was the Ganley Volkswagen proposal where a lot <br />of effort was spent speaking with people who were immediately adjacent to the <br />project when the project went through the Planning Commission. Then, when the <br />ordinance was introduced to rezone, property owners within a 1,000 feet were <br />notified and their response was, "How come we didn't know about the Planning <br />Commission meeting when this was discussed?" This was also an issue with the <br />proposed cell tower project on the North Olmsted High School property. Hopefully, <br />this notification issue will be addressed with this proposed change. <br />• Ordinance 2004-66, an ordinance amending Section 1161.05 of the city's Zoning <br />Code in order to adjust minimum parking standards for large-unit commercial <br />developments. This matter was discussed briefly. No recommendation was made at <br />this point because the matter is still subject to a public hearing, which will take place <br />on August 3. <br />AUDIENCE PARTICIPATION <br />Charles Dial, 27959 Gardenia, asked what was happening with the "on-going tabled <br />emergency" regarding the transformer replacement at the Waste Water Treatment Plant. <br />The last he heard, the city was to go out for another bid. Councilman McKay answered <br />that the matter has not been tabled. It is still in committee and awaiting a third request <br />for proposal. As soon as that is received, the project will move forward. Service <br />Director Driscoll came forward and agreed it is an emergency. The transformer is <br />leaking, and at some point it's going to reach a problem where it becomes a crisis. The <br />superintendent of the WWTP did immediately proceed and request an additional quote, <br />and he is still waiting for that quotation to be provided.
