Council Minutes of 6/15/2004 <br />13) On June 15, he received an additional correspondence from an attorney representing <br />Safety Director Richazd Jesse. If Council wishes to hear more about it, he will be happy <br />to talk with them individually or in executive session. <br />14) Council has considered 111 pieces of legislation in the first half of this yeaz and has <br />earned a vacation! <br />Councilman Miller asked the Finance Director how much money was left over from the <br />library project and how it would be used. Finance Director Copfer said the amount was <br />approximately eight hundred thousand dollars, but it did not include the fencing issue that <br />has recently been discussed. Also, she is not sure whether the art work has been <br />deducted. She will advise Council of the exact amount as soon as the month of May is <br />balanced. Whatever the number is, the leftover borrowed money must go to the library <br />bond retirement fund and be utilized to pay down debt when it is due because these aze <br />bonds. They cannot be paid down in advance. <br />President of Council Pro-Tem McKay: 1) The Council-as-a-Whole Committee met on <br />Tuesday, June 8. In attendance were all Council members, Law Director Dubelko, Safety <br />Director Jesse and several citizens. The committee met to discuss the details and the <br />proposed rules for the formal Council hearings that were approved by Council in 2003. <br />The following changes were approved by a 6-1 vote of Council: <br />• Pazagaph 1, the first word "upon" was changed to "following." Items a, b, c, d and e <br />remain the same. F was changed was changed to the wording, "Time allocated to <br />each member of Council to question a witness." <br />• It was agreed that the Chairman shall be the Presidern of Council. <br />• Pazagaph 4, the first three sentences were eliminated. The fourth sentence was <br />retained and after the word "witnesses" the word "shall" was added. The sentence <br />reads: "All witnesses shall be placed under oath and shall be advised of their rights as <br />established in the North Olmsted Codified Ordinances and state and federal statutes <br />before offering testimony." <br />• Paragraph 5 remains the same. <br />• Pazagraph 6, the word "may" was replaced with the word "shall" and reads: <br />"Subpoenas shall be served by personal service,..." <br />Councilman McKay requested that Councilman Gareau offer a motion regazding the <br />changes to the Rules of Council. Councilman Gareau made a motion to adopt as new <br />Council Rule No. 66 the procedure for formal Council hearings as amended by the <br />Committee-of-the-Whole. The motion was seconded by Councilman McKay. Roll call: <br />Gazeau, yes; McKay, yes; Dailey, yes; Kasler, yes; Limpert, yes; Miller, yes; Nashaz, yes, <br />with comment. He had originally been against the change but, after a conversation with <br />the Law Director, the issues he was concerned about were cleazed up. With that <br />clarification, he has reconsidered and is voting yes.
