Special Council Minutes of 5/26/2004 <br />Ordinance 2004-39. Again, it was stressed to the residents at that time that the site plan <br />and Ordinance 2004-39 would be dealt with separately. <br />The Flanning Commission reviewed the site proposal on January 27, 2004. It was <br />unanimously approved at that time. The committee first addressed the site plan on April <br />28, 2004, after the April 20, 2004 public hearing. The public hearing, for the record, had <br />to be set at least thirty days prior to the hearing to accommodate legal notices. It was also <br />discussed on May 17, 2004 and again on May 26, 2004. The project details are as <br />follows: <br />The building will be 34,200 feet. It will employ an additional 30 persons, with the <br />potential for an additiona120 in the future. The payroll tax is on income on the order of <br />1.3 to 2.0 million annually, or $26,400.00 to $40,000.00 in income tax generated. The <br />project has a budgeted cost, as represented by the developer, of $2.7 million dollars. The <br />proposal is to erect the structure on the eastern quadrant of the five parcels. No <br />modifications will be made to the current two structures also located on the site. The <br />building will be set back 88 feet from the street. There will be no display along Lorain <br />Road to accommodate landscaped strips. The site will be buffered on the west with a six <br />foot vinyl fence. The fence will traverse the entire western border where the rear yards <br />on Ranchview are located. It was represented that this was expressly worked out with the <br />residents on Ranchview. The agreement is as follows: <br />1. Ganley will increase the side yard set back from 20 to 25 feet from the <br />property line; <br />2. They will remove all miscellaneous vegetation in the setback zone; <br />3. They will maintain and manicure all healthy trees with a trunk diameter of <br />4 inches or more in the side yard; <br />4. They will install the fence 20 feet from the resident's property line into <br />their own property line; <br />5. They will extend residence current chain link fences to the new board on <br />board fence erected on their property; <br />6. They will plant a variety of evergreen fences within the side yard; <br />7. They will execute an easement to permit the residences to utilize the <br />additional 20 foot rear yard; <br />Considerable discussion arose as to the buffering on the property to the north. The <br />developer noted that there is, for most of the lot, about 300 feet of woodlands between the <br />property on the north and the rear yards of the homes on Timber Cove. However, it was <br />pointed out that is not entirely the case for the entire northern property line where some <br />areas have been cleared. The developer originally proposed a chain link fence; it was <br />then suggested at later meetings that a 6 foot fence be used of a solid nature, then there <br />was a 3 foot mound added with either a 6 foot fence or a row of arborvitae trees to form a <br />green screen; and then on May 26, a proposal was made that there be a 6 foot fence with <br />a 6 foot mound atop of the fence. The eastern property, because it is commercial, is <br />lightly landscaped with a fence to secure the premises. <br />3 <br /> <br />
