THE FOLLOWING IS AN EXCERPT OF THE MINUTES FROM <br />THE PLANNING COMMISSION MEETING HELD JANUARY 27, 2004 <br />(THESE MINUTES ARE SUBJECT TO APPROVAL AND MAY BE AMENDED) <br />1. Rezoning for 25600 Lorain Road (Ganiev Westside); WRD 1 <br />The proposal is to rezone the rear (north) portion of Permanent Parcel Numbers 232-34-O1 1, 232- <br />34-012, 232-34-013, 232-34-014, and 232-34-015 from B, Residence, Single to Retail Business, <br />General. Current zoning for the portions of Permanent Parcel Numbers 232-34-011 through 232-34- <br />015 within 500 feet of the centerline of Lorain Road (south portion) is Retail Business, General. <br />Current zoning for the remaining portions (north portions) of these parcels is B, Residence, Single. <br />The location is on the north side of Lorain Road approximately 160 feet east of Ranchview Avenue. <br />There is currently a separate proposal before Planning Commission to consolidate these parcels. <br />Department Reports - Ms. Wenger provided some background information on the project. She <br />indicated the Ganley lot is split zoned and abuts some residential property. It is the applicant's <br />second appearance before the Planning Commission and they appeared before the Architectural <br />Review Board twice and have made all the changes to the design of the building and the landscaping <br />as recommended by the Board. The applicant has met with representatives of the city to discuss <br />concerns and improvements to the project. She attended a meeting with Ganley and the residents on <br />the western property line a couple of weeks ago. The concerns relating to the rezoning are the use <br />of the back portion of the lot, lack of access to the residential portion, the desirability of creating a <br />development plan as a whole, and the overall quality of the site plan. The applicant has made the <br />suggested changes and the rezoning is a reasonable use of the land. Her recommendation is that the <br />Commission act on the rezoning request tonight and continue to work with the developer on the <br />plan, which is contingent on the rezoning of the property. Mr. Rymarczyk said there is currently <br />one variance required as a result of the rezoning request. <br />Applicant's Presentation - Mr. Jordan Burns, the attorney for Ganley, indicated they are seeking <br />unified zoning and they anticipate it can happen now without a variance. The plan has been revised <br />to eliminate the need for a variance. He thanked the planning department and the residents for the <br />input provided at their meeting. Mr. Jerry Herschman, the architect on the project, reviewed the new <br />plan including the materials to be used and the layout of the site. They have received favorable <br />reviews from the neighbors who will benefit from the project. He explained where the fence will be <br />placed and indicated the landscaping will extend the neighbors' yards 20 feet. The question of the <br />cut-off lighting was solved since they found the fixture they needed. <br />Commission Comments/Questions - Mr. Yager applauded the relationship between the Planning <br />Director, the applicant, and the residents. He asked that the applicant ensure there .are no visible <br />mechanical units on the site. Mrs. Hoff-Smith inquired about the lighting situation. Mr. Herschman <br />reviewed the plan. Mr. Rymarczyk said the applicant is still slated to go before the Board of Zoning <br />Appeals. If they wish to be removed from the agenda, he will need documentation from the <br />applicant. Mr. Herschman said he will take care of it. <br />Audience Participation - Mr. Paul Epple expressed concern about trees, buffering, and access on <br />the north side. He suggested Ganley continue the fence and landscaping on the north side. Mr. <br />Bruce Bruehler indicated he was not notified about the meeting that took place. He is concerned <br />about the noise, which is already bad, and property values. Commercial property owners should <br />r; have to abide by the zoning code.
