She did not believe that would be <br />the case. <br />The committee on May 17, 2004 voted 3-0 to make no recommendation to the Council on <br />the site plan. On May 18, 2004, the zoning ordinance and site plan were removed from <br />the agenda of the City Council and referred to this evening, May 26, 2004. <br />The BZD Committee met this evening, May 26, 2004. By a vote of 3-0, the committee <br />recommended approval to City Council that the site plan be approved with the following <br />conditions and recommendations: <br />1) All recommendations of the Boards and Commissions be followed and <br />adhered to in strict accordance; <br />2) That the rear property line include a six foot mound and a six foot fence to <br />traverse the entire property line; <br />3) That there be zero foot candles at all residential property lines; <br />4) That there be no loudspeakers; <br />5) That all drainage comply with Engineering standards; <br />6) That easements to the satisfaction of the Director of Law be executed to <br />allow access to the residents on Ranchview to their "extended" rear yards; <br />7) Again, the recommendation and encouragement was to encourage the <br />dealership to cease the practice of using car alarms to locate vehicles <br />within a number of vehicles; <br />8) It was also suggested and recommended that perhaps Gamey consider <br />discontinuance of using Ranchview, West Ranchview and Timber Cove <br />test drives. Those are residential neighborhoods and not commercial <br />areas. <br />Councilman Gareau made a motion to accept the Gamey site plan known as Gamey <br />Westside VW, 25600 Lorain Road, a proposal consisting of the construction of a third <br />building, which will be 34,200 square feet and house Ganley Westside Volkswagen, with <br />the caveat that this is one part of it. This concerns a site plan. The zoning matter will be <br />addressed with Ordinance 2004-39. The motion was seconded by Councilman Limpert. <br />President O'Grady questioned whether it should be pointed out that it was a six foot <br />mound with a six foot boazd-on-board fence. Councilman Gareau said it was a solid <br />vinyl fence. Law Director Dubelko recommended that the motion be conditional upon <br />the rezoning passing since the vote was being taken on just the development plan. <br />Councilman Gazeau agreed and withdrew the original motion, and Mr. Limpert withdrew <br />his second. Councilman Gazeau moved that his motion include his previous statements <br />and additionally include that this project site plan approval would be contingent upon the <br />passage of the rezoning. Mr. Gareau noted that his report should include several <br />documents as attachments to be made part of the record: a submittal by Gamey this <br />evening concerning the board on boazd fence, the six foot mound; a memo from David <br />Wendell (City Forester) concerning azborvitaes; a communication from Mr. Gazeau to <br />5 <br />
