Council-Minutes of 5/i8/20A4 <br />are not the owner, they did indicate that they would attempt to obtain that type of <br />assurance from Mr. Biskind and present it to the city. It's worth noting that Mr. Angelo <br />Skoulis who's been involved in this project as long as he has lived near the property for <br />several decades, indicated that with this most recent amendment he believes that it will be <br />satisfactory to the adjacent resident property owners. For the record, the previous use <br />was a 50-50 split between a residential and retail and the proposed use is now 75-25, 75 <br />being retail and 25 being office and community space. The committee voted to amend <br />and approve the preliminary land use plan subject to the following two conditions: a full <br />release be obtained from the owner to the satisfaction of the Director of Law concerning <br />any legal liability which remains outstanding from litigation; the plan will require them <br />to obtain any variances which will be deviations from the code as demonstrated on the <br />plan. Mr. Gareau moved that Council accept the amended preliminary land use plan with <br />the two qualifications as recommended by the committee. The motion was seconded by <br />Councilman McKay and passed unanimously. <br />AUDIENCE PARTICIPATION <br />Janet Saringer, 23336 Stoneybrook Drive, asked what changes were made in Ordinance <br />2003-128 to better regulate grade changes. Councilman McKay noted that anyone <br />applying for a grade change plan must submit a drainage plan with it. This is an effort to <br />control someone coming in and changing the elevation in their yard so water drains on <br />their neighbors. In the past, a drainage plan was not required. <br />Don Pangrac, 23470 Sharon Drive. <br />• Asked the Mayor if the left turn lane at Delmere was still in the plans. The Mayor <br />said it was and that's why the final coating has not been put down. Mr. Pangrac <br />noted that Sharon Drive at Claque Road, the pitch of the new asphalt is such that <br />there is a big water puddle in the middle of the street. It doesn't seem like a good <br />drainage plan. <br />• Regarding cell phones, he reminded Mr. Miller that he was to call him about this <br />issue. He would like the city to pass a similar law to Brooklyn where cell phone use <br />is banned. Mr. Miller apologized as he did not recall his promise to Mr. Pangrac. He <br />will put it on his checklist. <br />• A letter in the May 17th Cleveland Plain Dealer written by a resident of Perrysburg, <br />Ohio stated: "The Wall Street Journal reported on April 8 that Ohio now ranks third <br />in state tax burden behind only New York and Maine. In 1999, Ohio ranked 14th. <br />Ohio's tax burden is now 11.3%, which includes all state and local taxes as a <br />percentage of income." He wanted that fact to go on the record. <br />Michael Jablonski, 25149 Lessner, spoke at a previous Council meeting about the <br />condition of the city and offered some possible solutions but has not received any <br />feedback. He would like the city to send out a flyer to every household explaining some <br />of the common code violations. The Mayor thought it would be too expensive, but he has <br />since read a newspaper article that the city had some "found money." Councilman <br />Gareau explained it was not "found money."
