Council Minutes of 5/4/2004 <br />- ~ to the legislation were agreed upon. Mrs. Kasler made a motion to amend Resolution <br />~~'- 2004-68: (1) to note the legislation is for the purchase of cell phone service, not <br />purchase of phones since the phones are included in the contract (the old phones will <br />be retained for use in the Police Dept. at the suggestion of Councilman Miller); (2) a <br />cap on the expenditure for this service to $20,000 for two years (changed from <br />$25,000 at the recommendation of Councilman Limpert); (3) the addition of an <br />emergency clause; (4) the addition of a clause stating the lack of need for a formal bid <br />due to the dollar amount of the contract. The motion was seconded by Councilman <br />Gareau. Roll call: Kasler, yes; Gareau, yes; Dailey, yes; Nashar, yes; Miller, yes, <br />commenting that the use of the old cell phones is for Community Policing and use by <br />city crosswalk guards for no-cost emergency use to call 911. Roll call continued: <br />McKay, yes; Limpert, yes. The motion passed unanimously. The committee <br />unanimously recommended approval of Ordinance 2004-68 to include the <br />amendments and contingent upon receiving a final policy, signed and dated by the <br />administration, particularly the Mayor; and suspension of the rule was recommended. <br />As of this evening, she can report the final cell phone policy signed by the Mayor on <br />May 3 was received. <br />• Resolution 2004-27, a resolution authorizing the Director of Public Service to <br />advertise for bids for seven copy machine leases and service agreements. This <br />legislation had been held in committee, and the Service Director requested that it be <br />brought out of committee as he had completed compiling information which had been <br />requested by Council during the Finance appropriations. The information included <br />the number of machines in the city, where they are located, when the leases were to <br />be renewed and the cost of those leases. Mr. Driscoll brought all this information <br />back to the committee on Apri127, and the subject of renewal of the leases brought to <br />attention that leases renew at different times. Therefore, this legislation needs to be <br />amended to read six copy machines as opposed to seven. The number of machines in <br />the city is not being reduced, but rather the times at which they are renewed. The <br />committee unanimously recommended approval as amended and passage under <br />suspension of the rules. Councilwoman Kasler moved that Resolution 2004-27 be <br />amended to read six (6) copy machines instead of seven (7). The motion was <br />seconded by Councilman Limpert and passed unanimously. <br />Councilman Miller, chairperson of the Public Safety, Health & Welfare Committee: 1) <br />The committee met on Monday, April 26. Present were committee members Kasler and <br />Miller, City Prosecutor Ryan and Assistant Law Director O'Malley. The following item <br />was discussed: <br />• The North Olmsted Traffic and General Offenses Code. This was the first of several <br />meetings which will be held. This issue will involve a lot of work on the part of the <br />Law Department and some work from Council. Basically what has happened is Ohio <br />Senate Bill 123 has updated the state-wide code and North Olmsted needs to adjust its <br />code accordingly. It was the feeling of the Law Department that this would be a <br />timely place to begin discussion of changing some of our own traffic and general <br />offenses codes. Some of the issues preliminarily discussed included the following: <br />the DUI code is now an OVI code-operating a vehicle under the influence; driving <br />7 <br />
