It's a very thorough research and discusses a number of different <br />alternatives and a number of different recommendations that could take place. <br />Ordinance 2004-66 proposes to reduce the minimum parking to 5 instead of the <br />current 6.5 space per 1,000 square feet. Ms. Wenger did also recommend that a <br />flexible parking standard be used to give some leeway to the ordinance and to allow <br />it to become used in different ways in particular suitable situations. The legislation <br />has been referred to the Planning Commission as required. <br />• Ordinance 2003-93, an ordinance amending Sections 721.04, ?21.05, 721.Ob and <br />721.07 of the Business Regulation Code entitled "Temporary Business License; Fee <br />and Duration," "Location of Temporary Place of Business," and "Deposit for <br />Cleaning Premises" in order to further regulate the outdoor storage and sale of goods <br />from commercial parking areas, to restrict commercial tent and sidewalk sales and <br />declaring an emergency as amended. With good weather, the display of merchandise <br />is moved outdoors. This legislation, when it was originally introduced in 2003, <br />sought to address those particular unique issues. The committee has recognized that <br />the ordinance, as proposed, went too far. It attempted to regulate things that may not <br />necessarily need to be regulated.. Also, the committee was not comfortable with <br />some of the methods of regulation. The committee voted to hold the legislation with <br />the intent of substantially revising the ordinance and to bring it back to the table for <br />further discussion. <br />• Ordinance 2003-128 was originally scheduled for discussion. However, given the <br />nature of the ordinance as it deals with water runoff, the committee decided that it <br />should properly be reviewed by the Environmental Control Committee. <br />AUDIENCE PARTICIPATION <br />Dennis Lambert, 25057 Carey Lane. <br />• Questioned the need for 30 cell phones. It was explained that these are replacements, <br />not new phones. The phone use has been and will be continue to be monitored. The <br />annual cost of the phones is approximately $8,500. <br />Steve Fannin, 3784 Clague Road, Apt. 2. <br />• Questioned the Law Director about the action being taken with regard to the trash <br />issue at the apartment building. He is interested in the amount of the fine and the start <br />date of the fine. Mr. Dubetko said the city cited the property owner, and the case will <br />be heard for the first initial appearance in Rocky River Municipal Court on May 4. <br />A two-count complaint was filed, and possibly some additional citations may be filed <br />in the future. As to the fines, that is a complicated issue. The ordinance provides that <br />every day is a continuing violation. But not knowing how the judge may read that, <br />the Law Department will probably file a complaint every week to coincide with the <br />garbage pick-up day. It is a continuing violation every day, but they also would like <br />to have multiple complaints filed to get the best possible effort at getting compliance. <br />Mr. Fannin noted that the property owner has not made an effort to pick up the trash <br />even though he had contacted the residents by phone saying he would have the trash <br />picked up on Friday.
