Council Minutes of 4/6/2004 <br />Council approve the proposal to build a storage unit on Sublot 9 of the industrial <br />parkway subject to all the recommendations of the various boazds and commissions. <br />~ The motion was seconded by Councilman Limpert. Roll call: Gareau, yes; Limpert, <br />yes, with a brief comment that Mr. Schmidt was asked if he had explored the idea of <br />putting in something that would have more employment. He said he's been working <br />on it for 15 yeazs; therefore, he's going with what he's going with. Roll call <br />continued: Dailey, yes; McKay, yes; Miller, yes; Kasler, yes; Nashaz, yes. The <br />motion passed unanimously. <br />• Discussion and review of Ordinance 2004-51, an ordinance amending Sections <br />1101.05 and 1101.09 of Chapter 1101 of the Planning and Zoning Code entitled <br />"Subdivision Regulations" to increase the deposit amount for the review and <br />recording of major and minor subdivision plats, easements, preliminary plans, <br />topographic maps and other data submitted to the City Engineer. This is an <br />adjustment of fees chazged to record minor and major subdivisions, plats and <br />easements. Mr.1l~ller noted that the State of Ohio has recently doubled the fee that is <br />to be chazged for the recording of these various instruments. That increase goes <br />directly to the State of Ohio to help solve its budget problems. Our ordinance was <br />last changed in 1991. There was also a deposit requirement increase for <br />administrative review costs of these same types of instruments. The City Engineer's <br />office will chazge a $35 per hour fee, that's up from $30 that was previously listed. <br />The Engineer and Assistant Engineer will charge a $55 per hour fee pursuant to this <br />ordinance. The committee unanimously approved the legislation. <br />• Sunnyside Saturn, 27000 Lorain Road, a proposal to modify its current lighting <br />scheme. It should be noted there was no representative from Sunnyside, although it <br />was reported to the committee that they were notified of the meeting. In lieu of the <br />proposal by Sunnyside, Planning Director Wenger stepped up and gave the <br />presentation on this proposal. The proposal was to add additional lighting along the <br />western side neaz Lorain Road, the southwest corner, to cover what were referred to <br />as "dead spots." The lights aze similaz in all respects, including the design and color, <br />to the to the lighting currently on the lot. Architectural Review Boazd and the <br />Planning Commission recommended variances be approved, both in height and a <br />slight change in the permitted lighting. Those were ultimately recommended and <br />approved. One side issue that came up was that the landscaping along the front that <br />was never installed correctly when the original proposal was approved. All along it <br />was made clear to Sunnyside that they would in fact change that and correct what <br />they were supposed to have originally installed. It's been reported by the Planning <br />Director that they had been in communication with her and they have agreed to do <br />that. That was also represented to the various boards and commissions as they were <br />going through the administrative review process. There are no residential properties <br />which abut this particulaz pazcel. The committee recommended approval subject to <br />the recommendations of the boards and commissions and subject to the requirement <br />that Sunnyside in fact repair the landscape feature which was installed incorrectly. <br />Councilman Gareau moved that Council approve the proposal for additional lighting <br />at Sunnyside Saturn subject to the recommendations of the various boazds and <br />commissions and the r~uiremem that the landscape feature which was installed <br />incorrectly be repaired.
