MINUTES OF THE SPECIAL MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />THURSDAY, FEBRUARY 12, 2004 <br />Present: President of Council O'Grady, Council Members Dailey, Gareau, <br />Limpert, McKay, Miller, Nashar <br />Also Present: Mayor Musial, Law Director Dubelko, Clerk of Council Seman <br />Absent: Council Member Kasler <br />President O'Grady called the meeting to order at 7:32 p.m. in Council Chambers, 5200 <br />Dover Center Road, North Olmsted, Ohio. <br />LEGISLATION <br />Ordinance No. 2004-18 was introduced and placed on first reading by Mayor Musial. An <br />ordinance dispensing with an RFP process, authorizing the Director of Law to retain the <br />services of the law firm of Johnson, Angelo & Colaluca, L.L.C., as outside counsel to <br />assist the Director of Law in the city's current labor negotiations, including mediation, <br />fact-finding and conciliation; further authorizing the Mayor, following approval by the <br />Board of Control, to enter into a cornract with said law firm; and declaring an emergency. <br />Councilman McKay moved for suspension of the rules requiring three readings and <br />formal committee review and noted it had been discussed. The motion was seconded by <br />Councilman Gareau who noted it had not been formally reviewed by committee but it <br />was discussed in executive session. The motion passed unanimously. Councilman <br />McKay moved for adoption. The motion was seconded by Councilman Gareau. Roll <br />call: McKay, yes; Gareau, yes; Nashar, yes; Miller, yes with comment. He has discussed <br />the use of this firm with the Law Director. It is his hope that representatives from the <br />firm involved will treat all city employees with respect through the course of finalization <br />of this negotiation of contract. Roll call continued: Limpert, yes; Dailey, yes. The <br />motion passed unanimously. Ordinance No. 2004-18 adopted. <br />Resolution No. 2004-19 was introduced and placed on first reading by Mayor Musial. A <br />resolution accepting a FY2004 Community Development Block Grant ("CDBG") from <br />Cuyahoga County providing funding for the city's 2004 exterior maintenance program, <br />authorizing the Mayor to enter into an agreement with Cuyahoga County setting forth the <br />terms and conditions of the grant, and declaring an emergency. Councilman Gareau <br />moved for suspension of the rules requiring three readings and formal committee review. <br />The motion was seconded by Councilman Limpert and passed unanimously. Councilman <br />Gareau moved for adoption. The motion was seconded by Councilman Limpert. Roll <br />call: Gareau, yes; Limpert, yes; Dailey, yes; Miller, with comment. He would like to <br />thank Mr. Copeland and all the parties who worked with him in achieving both the funds <br />involved in 2004-19 and 2004-20. Roll call continued: Nashar, yes; McKay, yes.
