Council Minutes of 2/3/2004 <br />looked at the physical chazacteristics of the situation, they discussed the specifications <br />and the requirements of the equipment that will be needed. The Illuminating Company <br />representative brought the information back to their engineering department. They have <br />since contacted the city with a price on the transformer and found availability of the <br />transfer. But they indicated they weren't real confident that it was a good price and that <br />they wanted to further research this matter. Upon Councilman Limpert's <br />recommendation, another company was contacted regarding the same issue and the city is <br />trying to get separate pricing both of supplying the transformer and installing the <br />transformer. That is where the issue stands at this time. <br />Councilman Miller noted that Mr. Dial had brought up the issue that the cost of the <br />transformer should be the responsibility of the Illuminating Company rather than the city. <br />He wondered if there was a determination or commitment from them to cover the cost. <br />Mr. Driscoll said there was no commitment. Mr. Miller felt this might potentially be a <br />legal issue and should be referred to the Law Department. Mr. Driscoll said the Law <br />Department has not been brought into this discussion at this point in time. We will wait <br />and see what kind of proposal is received from the Illuminating Company, review it, and <br />then possibly submit that to the Law Department for their consideration and opinion. Mr. <br />Miller suggested that perhaps the Law Department should be brought into issues at the <br />beginning rather than at the end. We are not taking advantage of the fact that we have a <br />Law Department when we are creating potentially legal issues. Mr. Driscoll said that <br />was certainly a good recommendation and something to be considered. But, as of right <br />now, we have expressed to the Illuminating Company that they should consider their <br />responsibilities in providing this equipment and we have not received a reply. Mr. Miller <br />requested that Council be advised if another meeting is held with the Illuminating <br />Company and that Mr. Dial also be involved. <br />Roy Garland, 4576 Camellia, member of the Cultural Activities Committee <br />• Some weeks ago, they sent Council a letter and have had no response. They would <br />like to move quickly to get some things done. They were able to get the Town Hall <br />scheduled for a play this summer. The committee is aware that there are discussions <br />regarding the building of a new fire station in N. Olmsted and a senior citizens <br />center. It is hoped that possibly some of those things can be combined working with <br />the school district and Council to build a cultural arts center. It's too bad this wasn't <br />presented some time ago when the library was being planned as it could have been <br />piggybacked with the library. He recently saw a major facility in Houston, Texas <br />which combined a library, college classrooms, a fire station and a police department. <br />He noted that Cleveland is considering a property tax for the arts and wond+azed if <br />North Olmsted could find out about this in order to consider building a cultural arts <br />center, mainly a production area for plays. <br />• He suggested the city was in need of outdoor basketball courts. Our neighboring <br />city of Olmsted Falls has them and continues to have a good basketball program. <br />Also, our city needs a fitness center, and the safety forces could benefit from this <br />equipment. <br />10 <br />_. <br />i <br />
